Key Responsibilities:

BDS is a public defense office representing low-income New Yorkers in criminal, family, immigration, and civil legal matters. In addition to a zealous legal defense, our interdisciplinary teams of attorneys, social workers and advocates provide a wide range of legal and advocacy services, including for housing, public benefits, education, and employment. The Criminal Defense Practice represents and protects the legal rights of people who are arrested and are facing both misdemeanors and felony cases in Brooklyn and Queens Supreme and Criminal Courts. Our staff consists of attorneys, social workers, investigators, paralegals, and administrative professionals. BDS seeks an energetic social worker to become an integral part of the team to advocate for clients, both in and out of court.
Responsibilities
Partner collaboratively with attorneys and other experts to provide comprehensive legal representation and determine case strategy for clients facing criminal charges.
Responsible for a caseload of clients with varying needs and case-related deadlines, ensuring timely action and intervention.
Advocate orally for clients in court.
Produce mitigation reports on clients' behalf.
Conduct psychosocial assessments, develop service plans and refer clients for services.
Communicate with external service providers about client needs.
Maintain regular contact with clients including visits to incarcerated individuals.
Provide emotional support and guidance to clients, as well as crisis intervention when needed.
Maintain case notes and documentation in electronic database.

Qualifications

Ability to work collaboratively as part of the defense team in a client-centered practice.
Ability to write detailed and persuasive reports that include mitigation as part of the pre-pleading and post-conviction phase of the client's case.
Strong interpersonal skills in order to engage with family members, friends, neighbors, teachers, employers, and other potential mitigation/defense witnesses to obtain information regarding the client's background and/or evidence to support the defense of the case or mitigating circumstances.
Knowledge of the psychological, behavioral, and neurological conditions set forth in the DSM-5 as well as understanding of intergenerational and complex traumas.

Position Information
This is an exempt, salaried position in the collective bargaining agreement. The normal schedule is Monday to Friday 9am-5pm. The position is based at BDS' offices, and the courts located in Brooklyn, with jail and home visits as needed.
Salary for this position is based on the experience of the applicant and ranges from approximately $80,000-$89,000. The Neighborhood Defender Service of Harlem (NDS) is a community-based, client-centered, holistic public defense office located in Harlem, providing the highest quality legal representation in criminal, civil, immigration and family courts to residents of Northern Manhattan and the Bronx who cannot afford to hire a lawyer.
The Family Defense Practice at NDS represents parents in family policing cases (sometimes called “child welfare” or “child protection” cases) filed by the Administration for Children's Services (ACS) as well as related family court cases, including custody, visitation and termination of parental rights proceedings. Through our holistic approach to representation, the Family Defense Practice provides parents with the help they need-both inside and outside of court-to keep their families safe and stable. NDS is committed to advancing due process rights for parents by fighting unwarranted state intervention in their lives and advocating for related systemic change. The non-attorney advocate (social worker or client advocate) is an essential part of a client's interdisciplinary team and will work closely with team administrators, litigation assistants and attorneys to provide vigorous advocacy to clients with ACS, foster agencies, and service providers.
Responsibilities
NDS is seeking to hire at least one social worker and/or client advocate to start as soon as possible.
Provide energetic, enthusiastic, and creative client-centered holistic advocacy for clients targeted by the family policing system;
Work as part of the interdisciplinary team, including attorneys and other non-attorney advocates, to determine case strategy;
For social worker role, contribute to legal strategy by analyzing and assessing clients' past diagnoses, service participation, and treatment history, as well as other mitigating factors.
Advocate for clients in-person and virtually at ACS and foster agency case conferences;
Advocate for clients in-person and virtually at school, hospital, and other meetings related to litigation;
Meet with clients in-person and virtually in collaboration with attorneys to prepare for court appearances;
Conduct client interviews and assessments in-person and virtually to determine social work needs;
Identify and secure placement of clients in programs and services intended to advance cases with allegations of mental illness, addiction, domestic violence, and disability;
Work with clients to determine if any community resources serve their legal and/or social work needs;
Communicate and advocate with service providers about clients' needs;
Provide crisis intervention management;

Qualifications
NDS is seeking applicants with a demonstrated commitment to parents' rights, indigent defense, social justice issues and/or the Harlem and/or Bronx communities;
Experience working in Family Court and/or the family policing system preferred;
Lived experience with the Family Policing System and other systems impacting NDS's clients preferred;
Must possess excellent interpersonal, analytical, writing, and communication skills;
Must possess strong organizational skills and the ability to be flexible in order to manage a high caseload in a very fast-paced environment;
Must be comfortable in a court environment, and potentially testify under oath in special circumstances;

Compensation
Compensation is commensurate with experience and is in adherence to the NDS compensation scale. For a social worker position, the salary range for 1-5 years of directly relevant experience is $73,440.00 to $78,582.23.
For a client advocate position, the salary range for 1-5 years of directly relevant experience is $55,904.13 to $61,003.80.

The social worker will assess the needs of the family, identify and connect families to community supports and services, and coordinate team meetings to ensure the youth and family's needs and plans are being addressed/implemented.
Case Planner - the social worker works with youth (and their families) to support them and prevent abuse or removal of the children in the family. If youth are already in foster care, the social worker is working with both foster parents and the youth's family. There are many exciting programs that utilize different therapies, such as trauma systems therapy and family function therapy-therapeutic case management.
Supervisor - there are many supervisor positions for the various case planner or care manager positions. For these positions, candidates are expected to have had direct service child welfare positions or related positions.
Coordinator - there are several positions available for a program that specifically supports and advocates for the youth of these families (So they're the advocate for the child specifically, not for the whole family.)
