Responsibilities

* Independently represent the Employer/Carrier before the assigned Judge of Compensation Claims and present witnesses and evidence at administrative hearings on litigated workers' compensation claims.
* Analyze complex legal and factual issues, conduct extensive, well-reasoned legal research, independently develop and present defense strategies on behalf of the Employer/Carrier.
* Prepare pleadings, written discovery, motions and briefs in support of defense strategies.
* Provide effective and timely communications, information, legal advice and other services to clients and claims professionals on legal and factual issues.
* Position requires the use of independent judgment, research, litigation and analytical skills.
* Assist in developing training materials for the WC claim department.
* Work with the WC claim department and Law Department on special projects related to the practice of workers' compensation.
* Communicate with the Office of the Judges of Compensation Claims, witnesses, opposing counsel and clients in a manner consistent with established office procedures.
* Responsible for the prompt, efficient and effective disposition of assigned cases.
* Attend continuing legal education seminars in order to maintain high level of professional expertise.

* Florida Bar licensed attorney.
* Knowledge of Floridas Workers' Compensation statutes and its application.
* 3+ years' workers' compensation litigation experience

Legal Counsel II-Workers Compensation

Responsible for competent, ethical and diligent representation of AmTrust North America and its carriers in all assigned cases including preparation of pleadings, motions, pre-trial discovery, trial, arbitration and appellate work. This position requires aggressive, cost-efficient and creative management of a caseload involved in full-phase litigation. It entails traveling to different Boards in Southern California and to various AmTrust offices. The ideal candidate should possess skills necessary to interface with claims administrators, underwriters, employers, safety personnel, and all legal representatives up to the highest ranks at the WCAB level. In addition to handling a caseload, this position involves maintaining regular communications with the Claims Department via roundtables, reviews and training. The ideal candidate must maintain a solid understanding of AmTrust's mission, vision, and values as best in class in the workers' compensation industry.
Responsibilities

* Provides thorough and timely communication, information, legal advice and other services to Claims, Underwriting and employers on relevant legal and factual issues;
* Possesses the ability to comply with the AmTrust's Litigation Management Guidelines with minimal supervision
* Assists in developing training materials for Claims, Underwriting and employers relevant to the application of current laws, practices and trends in CA workers' compensation
* Competently handles carve-out cases and possesses familiarity with the practices and procedures of the Alternative Dispute Resolution Program (ADR)
* Communicates with Workers' Compensation Judges, claims professionals, witnesses, opposing counsels and clients in a manner consistent with established office procedures
* Keeps current with market trends and demands. Attends continuing legal education seminars in order to maintain high level of professional expertise

Qualifications

Required:

* Licensed by the California State Bar
* Strong technical knowledge and familiarity with the California Labor Code and Rules of Practice and Procedure as well as current case law and their application
* Ability to handle a caseload of up to 95 cases from inception to settlement and/or appellate level• 5+ years of experience for Staff Counsel II; Experience must be recent and relevant to the practice of Workers' Compensation
* Strong working knowledge of EAMS, Jet Filing, Lexis Advance, Microsoft Office
* Trial and/or arbitration experience up to submission consistent with years of experience above
* Appellate experience consistent with years of experience above
* Ability to travel to various WCAB district offices in California as well as other locations including but not limited to periodic travel to various AmTrust Offices in San Diego, Irvine, Concord and Las Vegas

The Workers' Compensation Claims, Medical Only Supervisor is responsible to supervise activities within the worker compensation lost time claims department. This may encompass supervision of administrative tasks and staff or oversight of the investigation of insurance claims involving workers compensation, property or casualty claims based on coverage, appraisal and verifiable injury or damage. This position involves the direct handling of tasks and/or claims in addition to supervision of staff. The WC Claims, Medical Only Supervisor reports to the WC Manager.
Responsibilities

* May oversee the handling of all aspects of the claims assigned to the unit including reserving, communication, documentation, evaluation, negotiation and settlement
* Ensures all claims eligible or ineligible for payment conform to quality, production standards, and specifications
* Ensures claim processing is consistent with applicable policies, procedures and department guidelines
* Analyzes and approves workers compensation claims
* Completes regular quality audits of staffs work, records results and counsels staff to bring work to or above standards
* Prepares regular periodic reports and monitors system reports to ensure adherence to corporate and regulatory standards
* Establishes and executes controls to assure that the quality of the work meets or exceeds standards
* Reviews and analyzes processes, procedures, and workflows to identify opportunities for process improvement and efficiency

Qualifications

* Bachelor's degree or equivalent combination of work experience and education required
* 5+ years' experience in workers' compensation insurance industry
* Valid adjusters license in appropriate jurisdictions or ability to obtain such

Medical Case Manager, Irvine

AmTrust Financial Services, a fast growing commercial insurance company, has a need for a Telephonic Medical Case Manager, RN.

PRIMARY PURPOSE: To provide comprehensive quality telephonic case management to proactively drive a medically appropriate return to work through engagement with the injured employee, provider and employer. Our nurses will be empathetic informative medical resources for our injured employees and they will partner with our adjusters to develop a personalized holistic approach for each claim. These responsibilities may include utilization review, pharmacy oversight and care coordination.
Responsibilities

* Uses clinical/nursing skills to determine whether all aspects of a patient's care, at every level, are medically necessary and appropriately delivered.
* Perform Utilization Review activities prospectively, concurrently or retrospectively in accordance with the appropriate jurisdictional guidelines.
* Sends letters as needed to prescribing physician(s) and refers to physician advisor as necessary
* Responsible for accurate comprehensive documentation of case management activities in case management system.
* Uses clinical/nursing skills to help coordinate the individual's treatment program while maximizing quality and cost-effectiveness of care including direction of care to preferred provider networks where applicable.
* Addresses need for job description and appropriately discusses with employer, injured employee and/or provider. Works with employers on modifications to job duties based on medical limitations and the employee's functional assessment.
* Responsible for helping to ensure injured employees receive appropriate level and intensity of care through use of medical and disability duration guidelines, directly related to the compensable injury and/or assist adjusters in managing medical treatment to drive resolution.
* Communicates effectively with claims adjuster, client, vendor, supervisor and other parties as needed to coordinate appropriate medical care and return to work.
* Performs clinical assessment via information in medical/pharmacy reports and case files; assesses client's situation to include psychosocial needs, cultural implications and support systems in place
* Objectively and critically assesses all information related to the current treatment plan to identify barriers, clarify or determine realistic goals and objectives, and seek potential alternatives.
* Partners with the adjuster to develop medical resolution strategies to achieve maximal medical improvement or the appropriate outcome
* Evaluate and update treatment and return to work plans within established protocols throughout the life of the claim.
* Engage specialty resources as needed to achieve optimal resolution (behavioral health program, physician advisor, peer reviews, medical director).
* Partner with adjuster to provide input on medical treatment and recovery time to assist in evaluating appropriate claim reserves
* Maintains client's privacy and confidentiality; promotes client safety and advocacy; and adheres to ethical, legal, accreditation and regulatory standards.
* May assist in training/orientation of new staff as requested
* Other duties may be assigned.
* Supports the organization's quality program(s).

Qualifications

Education & Licensing

Active unrestricted RN license in a state or territory of the United States required. Bachelor's degree in nursing (BSN) from accredited college or university or equivalent work experience preferred. Certification in case management, pharmacy, rehabilitation nursing or a related specialty is highly preferred. Acquisition and maintenance of Insurance License(s) may be required to comply with state requirements. Preferred for license(s) to be obtained within three - six months of starting the job. Written and verbal fluency in Spanish and English preferred

Experience

Five (5) years of related experience or equivalent combination of education and experience required to include two (2) years of direct clinical care OR two (2) years of case management/utilization management required.

Skills & Knowledge: Knowledge of workers' compensation laws and regulations

Knowledge of case management practice

Knowledge of the nature and extent of injuries, periods of disability, and treatment needed

Knowledge of URAC standards, ODG, Utilization review, state workers compensation guidelines

Knowledge of pharmaceuticals to treat pain, pain management process, drug rehabilitation Knowledge of behavioral health Excellent oral and written communication, including presentation skills PC literate, including Microsoft Office products Leadership/management/motivational skills Analytic and interpretive skills Strong organizational skills Excellent interpersonal and negotiation skills Ability to work in a team environment Ability to meet or exceed Performance Competencies WORK ENVIRONMENT
