Yes, it is illegal to pay employees late. Federal law states that employers must pay their employees on a previously decided upon payday, and failure to do so is an illegal act, and legal action, such as lawsuits and costly penalties, could result.

Per the FLSA, a late payment is considered the same as no payment for employees. This means that the employer is punished the same as if they did not make a payment at all.
There are two types of non-payments. These are willful and non-willful non-payments. Willful non-payments are when the company does not pay or pays late, on purpose. Non-willful nonpayment simply means something outside of the company's control occurred that caused a delay in payment. This generally is not punished.
