Who is responsible for workplace safety?

Employers are responsible for workplace safety. Under OSH law, employers have the primary responsibility of making sure their workplace is safe for all employees, as well as anyone else that enters the environment.

Here are some examples of the responsibilities OSHA (Occupational Health and Safety Administration) places on employers regarding workplace safety:

  • Provide a workplace free from severe recognized dangers and comply with standards, rules, and regulations related to the OSH Act

  • Examine workplace conditions and specific facilities to make sure they comply to OSHA standards

  • Ensure employees use safe tools and equipment and properly take care of this equipment, including all maintenance procedures

  • Utilize color codes, posters, labels or signs to warn employees of possible dangers in the workplace

  • Establish and/or update operating procedures that affect health and safety, and communicate them clearly to employees

  • Employers must provide safety training in a way in which all workers can understand, meaning sometimes in multiple languages and/or formats

  • Employers with dangerous chemicals in the workplace must create and implement a written hazard communication program and train employees on the dangers they are exposed to and the proper precautions to take when working with these materials

  • Provide training and medical examinations when directed by OSHA standards

  • Post the OSHA poster (or the state-plan equivalent) informing employees of their rights and responsibilities concerning workplace safety

  • Employers must report to the nearest OSHA office all work-related fatalities within 8 hours, and all work-related hospitalizations, all body amputations and all losses of an eye from a workplace event within 24 hours

  • Keep accurate and current records of work-related injuries and illnesses

  • Provide access to employee medical records and hazardous exposure records to employees or authorized representatives of the employees
