OPLA is the largest legal program in the Department of Homeland Security (DHS), employing over 1,700 attorneys nationwide. In addition to Headquarters in Washington, D.C., there are 24 OPLA Field Locations in more than 60 cities throughout the United States. Pursuant to statute, OPLA serves as the exclusive representative of DHS in removal proceedings before the Executive Office for Immigration Review litigating cases involving criminal aliens, terrorists, human rights violators, and other priority aliens. OPLA also provides a full range of legal services to all ICE programs and offices.
OPLA attorneys provide legal advice and prudential counsel to ICE personnel on their law enforcement authorities, legal liability under the Federal Tort Claims Act and Bivens v. Six Unknown Named Agents of Fed. Bureau of Narcotics, 403 U.S. 388 (1971), the Freedom of Information Act and Privacy Act, ethics, and a range of administrative law issues, such as contract, fiscal and employment law. OPLA attorneys represent the agency before the Merit Systems Protection Board, the Equal Employment Opportunity Commission, and the Contract Board of Appeals. OPLA attorneys support the Department of Justice in the prosecution of ICE cases and in the defense of civil cases against ICE.
The selected attorney will immediately be given significant responsibilities and will be expected to craft legally supportable policies to address the needs of agency operational components. The attorney will be expected to routinely provide timely legal opinions to ICE officers and agents, management, and leadership within OPLA, ICE, and DHS's Office of the General Counsel Headquarters. The selected attorney will be required to assess litigation risk and provide litigation support to the Department of Justice.
As a General Attorney, you will perform the following duties at the full performance level:
* Represent the United States Government in removal proceedings before immigration judges, frequently involving applicants for asylum or for other forms of relief under immigration laws;
* Provide expert legal counsel in the interpretation of highly complex immigration and customs laws including comprehensive and in-depth knowledge of statutory, regulatory and case authorities;
* Prepare cases for litigation by conducting legal research; prepare pleadings, motions, briefs, stipulations, affidavits, and other legal documents;
* Prepare witnesses for litigation; conduct direct examination and cross examination; present oral arguments advancing ICE's legal position; negotiate the disposition of cases with opposing counsel; and advise the Chief Counsel and/or Deputy Chief Counsel on cases potentially warranting deferred action or other exercise of prosecutorial discretion;
* Construct litigation reports for United States Attorney's Offices on civil matters pending in the federal courts involving ICE, and serve as liaison between Department of Justice's Office of Immigration Litigation and the local Enforcement and Removal Field Office on immigration matters pending in the Circuit Courts of Appeals;
* Provide legal advice and support to the other ICE components and litigation support to United States Attorney's Offices in immigration and/or customs matters. The position also involves appellate advocacy before the Board of Immigration Appeals, including the preparation of briefs and other pleadings.

Job Summary
The Deputy Prosecuting Attorney represents the State of Idaho as a trial attorney in the prosecution of criminal, quasi-criminal, and limited civil actions in Juvenile, Magistrate, and District Court proceedings and assist the elected Prosecuting Attorney in performing the statutory and constitutional functions of the office.
This is a multi-level class series in which incumbents may be assigned to any of five levels, depending on organizational needs, professional legal experience, individual expertise and skill, proficiency, and complexity of assigned caseload. Positions in these classes are flexibly staffed and are normally filled by advancement from the entry level. Progression from one level to the next is at the discretion of the appointing authority, provided minimum qualifications are met.
Positions within the class:
Rule 226 Provisional Deputy is the pre-entry level in the Deputy Prosecuting Attorney (DPA) series, assigned to law students and recent law school graduates studying for the Bar Exam. Provisional Deputies are legal interns admitted under Idaho Bar Commission Rule 226 to the limited practice of law.
Deputy Prosecuting Attorney I is the entry level in the (DPA) series, assigned to employees with limited previous legal experience who are fully licensed to practice law in the State of Idaho. This class is typically used as a training class and employees work under immediate supervision while learning job skills and tasks.
Deputy Prosecuting Attorney II is the first working level assigned to employees with at least the equivalent of one year as a DPA I. Under general supervision, employees at this level perform work of average difficulty in all phases of criminal, quasi-criminal, and limited civil practice.
Deputy Prosecuting Attorney III is the full journey level assigned to employees with the equivalent of at least two years' experience as a DPA. Employees at this level are assigned increasing difficult and complex cases and should require limited instruction or assistance.
Deputy Prosecuting Attorney IV is the senior journey level assigned to employees with the equivalent of at least three years' experience as a DPA. Employees at this level are generally assigned more difficult and sensitive cases, are fully aware of the operating procedures and policies within the CCPA and require only occasional instruction or assistance as necessary.

Job Summary
The Deputy Prosecuting Attorney represents the State of Idaho as a trial attorney in the prosecution of criminal, quasi-criminal, and limited civil actions in Juvenile, Magistrate, and District Court proceedings and assist the elected Prosecuting Attorney in performing the statutory and constitutional functions of the office.
This is a multi-level class series in which incumbents may be assigned to any of five levels, depending on organizational needs, professional legal experience, individual expertise and skill, proficiency, and complexity of assigned caseload. Positions in these classes are flexibly staffed and are normally filled by advancement from the entry level. Progression from one level to the next is at the discretion of the appointing authority, provided minimum qualifications are met.
Positions within the class:
Rule 226 Provisional Deputy is the pre-entry level in the Deputy Prosecuting Attorney (DPA) series, assigned to law students and recent law school graduates studying for the Bar Exam. Provisional Deputies are legal interns admitted under Idaho Bar Commission Rule 226 to the limited practice of law.
Deputy Prosecuting Attorney I is the entry level in the (DPA) series, assigned to employees with limited previous legal experience who are fully licensed to practice law in the State of Idaho. This class is typically used as a training class and employees work under immediate supervision while learning job skills and tasks.
Deputy Prosecuting Attorney II is the first working level assigned to employees with at least the equivalent of one year as a DPA I. Under general supervision, employees at this level perform work of average difficulty in all phases of criminal, quasi-criminal, and limited civil practice.
Deputy Prosecuting Attorney III is the full journey level assigned to employees with the equivalent of at least two years' experience as a DPA. Employees at this level are assigned increasing difficult and complex cases and should require limited instruction or assistance.
Deputy Prosecuting Attorney IV is the senior journey level assigned to employees with the equivalent of at least three years' experience as a DPA. Employees at this level are generally assigned more difficult and sensitive cases, are fully aware of the operating procedures and policies within the CCPA and require only occasional instruction or assistance as necessary.
Key Responsibilities:
·Manage assigned cases:
o Perform screening duties, including review of incoming police reports to determine which charges, if any, will be filed against whom
o Prepare complaints
o Prepare witness list and confer with citizen witnesses and law enforcement agents
o Research case-specific legal issues and draft motions, orders, and memoranda
o Negotiate potential case resolutions with defense counsel/defendants as appropriate, in accordance with facts, law, and policy
o Prepare questions, legal strategies, jury instructions, jury selection, opening and closing statements
o Prepare witness for trial
o Present evidence and argument at arraignments, preliminary hearings, hearings on motions, trials, juvenile proceedings, mental commitment proceedings, and Grand Jury

o Conduct legal research as necessary to stay abreast of court decisions and legislation affecting practice of criminal law
o Conduct training for law enforcement agents designed to improve procedures for arrests, searches, seizures, etc.
o Exercise direct supervision over attorney, investigators, and support staff in accordance with Office policies and procedures
o Participate in interview and evaluation and training of employees

o Respond to legal questions from law enforcement agencies and obtain search warrants by being on call 24 hours per day, per the duty roster of the CCPA
o Conduct outreach and advise the public on criminal practice and issues of community concern, including the rights of victims, complainants, and witnesses

The Deputy Prosecutor III provides professional legal services, which include prosecuting felony, misdemeanor, and/or juvenile cases, making charging decisions, negotiating case settlements, and assisting the County Prosecutor with other legal and administrative work necessary to achieve the objectives of the office. Assignments may be made to prosecute specific types of cases such as major crimes, complex litigation, serious felony, and civil cases. The position provides general direction to assigned legal and other assistant support positions but is not a supervisory position. While the work is performed under the general supervision and authority of the County Prosecutor, there the position is expected to exercise independent judgment, initiative, and discretion to manage the assigned caseload.
Essential Duties and Responsibilities
The Deputy Prosecutor III assumes daily responsibility and performs tasks in the following areas:
Investigates, prepares, and manages felony, misdemeanor, and/or juvenile cases for trial, including but not limited to: reviewing charges and evidence, conducting legal research, interviewing affected parties, preparing required legal and court documents, preparing, and arguing briefs, and attending court proceedings,
May be assigned specific types of cases such as major crimes, complex litigation, serious felony, and civil cases, or other complex specializations,
Makes charging decisions following review and evaluation of police reports and other evidence and in consideration of applicable law,
Negotiates case settlements with opposing counsel,
Advises and consults with police officers, detectives, attorneys, defendants, victims, witnesses, and other interested and affected parties,
Represents the County's interest in court,
Answers communications from the public relative to legal matters affecting the County,
Other Duties and Responsibilities:
May be assigned on call after regular hours to respond to emergency situations, or other duties as assigned or necessary to aid the department in the completion of its objectives.
Performs all work duties and activities in accordance with County policies, procedures, and safety practices.
Competency Requirements
The Deputy Prosecutor III obtains, possesses, and deploys the following knowledge, skills, and abilities to effectively perform their responsibilities:
Knowledge Of:
Legal, court, and judicial procedures, rules, terminology, methods, documents, practices, and objectives typically used in a courtroom environment,
Applicable federal, state, and municipal laws, statutes, ordinances, and code needed for practice of the assigned caseload and duties, and their application to county government,
Legal research methods and applications used to determine established precedents and sources of legal references applicable to the County caseload and current legal issues, and
Skill To:
Analyze evidence, organize facts, identify precedents, weigh alternatives, and anticipate possible to develop and deploy an appropriate legal strategy and logical argument(s),
Appear without assistance in court and other judicial proceedings and be able to present evidence, arguments, testimony, and witnesses before a judge or jury,
Negotiate complex legal issues with opponents, and bring interested and affected parties to consensus,
Operate standard office equipment, including a personal computer, printer/scanner, and job-related software applications, and
Make significant/substantial legal decisions in individual cases based on a combination of factors including the law, policy, and rules of ethics.
Ability To:
Communicate effectively, both orally and in writing, for purposes of advocating, persuading, negotiating, and counseling for or on behalf of the County,
Maintain a professional demeanor during all situations, and maintain effective working relationships with other County employees, staff, attorneys, law enforcement personnel, victims, witnesses, supervisory personnel, agency stakeholders, state and local elected and appointed officials, and the public, and
Perform a wide variety of duties and responsibilities with accuracy and speed under the pressure to meet time-sensitive deadlines, and be able to perform multiple tasks simultaneously, manage case priorities, including handling interruption and change, and
Demonstrate character, integrity, and ingenuity in representing the County.
Graduation from a school of law accredited by the American Bar Association with a Juris Doctorate Degree (JD),
Admission to the Idaho State Bar with an active license to practice law in the State of Idaho,
Meet any annual licensing requirements and maintain a membership in good standing in the Idaho State Bar Association, and
Three (3) years of career experience and three (3) years of Bannock County prosecuting experience, or equivalent combination of experience.

The principal duties of this position are performed in a general office and courtroom environment.
