OPLA is the largest legal program in the Department of Homeland Security (DHS), employing over 1,700 attorneys nationwide. In addition to Headquarters in Washington, D.C., there are 24 OPLA Field Locations in more than 60 cities throughout the United States. Pursuant to statute, OPLA serves as the exclusive representative of DHS in removal proceedings before the Executive Office for Immigration Review litigating cases involving criminal aliens, terrorists, human rights violators, and other priority aliens. OPLA also provides a full range of legal services to all ICE programs and offices.
OPLA attorneys provide legal advice and prudential counsel to ICE personnel on their law enforcement authorities, legal liability under the Federal Tort Claims Act and Bivens v. Six Unknown Named Agents of Fed. Bureau of Narcotics, 403 U.S. 388 (1971), the Freedom of Information Act and Privacy Act, ethics, and a range of administrative law issues, such as contract, fiscal and employment law. OPLA attorneys represent the agency before the Merit Systems Protection Board, the Equal Employment Opportunity Commission, and the Contract Board of Appeals. OPLA attorneys support the Department of Justice in the prosecution of ICE cases and in the defense of civil cases against ICE.
The selected attorney will immediately be given significant responsibilities and will be expected to craft legally supportable policies to address the needs of agency operational components. The attorney will be expected to routinely provide timely legal opinions to ICE officers and agents, management, and leadership within OPLA, ICE, and DHS's Office of the General Counsel Headquarters. The selected attorney will be required to assess litigation risk and provide litigation support to the Department of Justice.
As a General Attorney, you will perform the following duties at the full performance level:
* Represent the United States Government in removal proceedings before immigration judges, frequently involving applicants for asylum or for other forms of relief under immigration laws;
* Provide expert legal counsel in the interpretation of highly complex immigration and customs laws including comprehensive and in-depth knowledge of statutory, regulatory and case authorities;
* Prepare cases for litigation by conducting legal research; prepare pleadings, motions, briefs, stipulations, affidavits, and other legal documents;
* Prepare witnesses for litigation; conduct direct examination and cross examination; present oral arguments advancing ICE's legal position; negotiate the disposition of cases with opposing counsel; and advise the Chief Counsel and/or Deputy Chief Counsel on cases potentially warranting deferred action or other exercise of prosecutorial discretion;
* Construct litigation reports for United States Attorney's Offices on civil matters pending in the federal courts involving ICE, and serve as liaison between Department of Justice's Office of Immigration Litigation and the local Enforcement and Removal Field Office on immigration matters pending in the Circuit Courts of Appeals;
* Provide legal advice and support to the other ICE components and litigation support to United States Attorney's Offices in immigration and/or customs matters. The position also involves appellate advocacy before the Board of Immigration Appeals, including the preparation of briefs and other pleadings.

Job Summary

Progression from one level to the next is at the discretion of the appointing authority, provided minimum qualifications are met.
Positions within the class:
Rule 226 Provisional Deputy is the pre-entry level in the Deputy Prosecuting Attorney (DPA) series, assigned to law students and recent law school graduates studying for the Bar Exam. Provisional Deputies are legal interns admitted under Idaho Bar Commission Rule 226 to the limited practice of law.
Deputy Prosecuting Attorney I is the entry level in the (DPA) series, assigned to employees with limited previous legal experience who are fully licensed to practice law in the State of Idaho. This class is typically used as a training class and employees work under immediate supervision while learning job skills and tasks.
Deputy Prosecuting Attorney II is the first working level assigned to employees with at least the equivalent of one year as a DPA I. Under general supervision, employees at this level perform work of average difficulty in all phases of criminal, quasi-criminal, and limited civil practice.
Deputy Prosecuting Attorney III is the full journey level assigned to employees with the equivalent of at least two years' experience as a DPA. Employees at this level are assigned increasing difficult and complex cases and should require limited instruction or assistance.

The Chief City Prosecutor prosecutes violations of the municipal code and is responsible for the daily supervision of City Prosecutors, for training, developing, and mentoring new and experienced prosecutors in the practice of misdemeanor prosecution for the City, assisting in the supervision of support staff, and performing professional legal work in preparing and prosecuting cases. The Chief City Prosecutor also assists the City Attorney in providing legal advice to the Cheyenne Police Department and with other matters as assigned.
PRIMARY DUTIES AND RESPONSIBILITIES
* Daily supervision of city prosecutors and support staff within the Prosecution Division of the City's Attorney's Office; and trains and serves as a resource for new attorneys and support staff in the Division;
* Prosecute misdemeanor cases in municipal court, including evaluation of citations filed by the Cheyenne Police Department; make charging decisions; prepare discovery; and draft pleadings;

* In consultation with the City Attorney, provide legal advice to the Cheyenne Police Department, including advice on public records requests, contract review, and policy and procedure within the Department;
* In consultation with the City Attorney, provide proactive and preventive legal advice to prevent lawsuits, claims, and other issues from arising;
* Perform general legal research; utilize law libraries and other research mechanisms; and keep current on relevant legal issues;
* Participate in the selection and evaluation, as well as discipline, of legal support staff, and prosecutors; and planning, organizing, and overseeing the work of other prosecutors with a commitment to quality and continuous improvement;
* Maintain compliance with licensing and continuing legal education rules of the Wyoming State Bar.

GENERAL JOB DESCRIPTION
Under the general supervision of the City Attorney, prepares and handles criminal prosecutions. Assists the City Attorney in representing the Cheyenne Police Department and other civil matters as assigned.
PRIMARY DUTIES AND RESPONSIBILITIES
Prosecute misdemeanor cases in municipal court, including evaluation of citations filed by the Cheyenne Police Department; making charging decisions; conducting legal research; preparing and responding to discovery; drafting pleadings; negotiating case resolutions; Representing the City in Municipal Court and conducting both bench trials and jury trials. Respond to inquiries and provide legal advice regarding criminal law and procedure to the Mayor, City Council, City departments and various boards and commissions.
Provide legal advice to the Cheyenne Police Department. Including advice on public records requests, contract review, and policy and procedure within the Department.
Provide proactive and preventive legal advice to prevent lawsuits, claims, and other issues from arising.
Receive and respond to public inquiries, citizen complaints, and requests for information.
Perform general legal research; utilize law libraries and other research mechanisms; and keep current on relevant legal issues.
Respond to inquiries from courts, the District Attorney's Office, Youth Alternatives, and other agencies.
Maintain compliance with licensing and continuing legal education rules of the Wyoming State Bar.
SECONDARY DUTIES AND RESPONSIBILITIES
Perform other duties and responsibilities as required.
KNOWLEDGE, SKILLS AND ABILITIES
Operations, services, and activities of a City Attorney's Office.
Relevant principles of civil, criminal, constitutional and administrative laws, codes, and regulations.
Federal and state criminal laws and procedure.
Methods and techniques of legal research.
Organization, duties, powers, limitations, and authority of City government.
Modern office procedures, methods, and equipment, including computers and applicable software applications.
Provide responsive, timely assistance to the City Attorney and other supervisory or management staff.
Prepare and prosecute criminal cases from initial intake, up to and including trial.
Prepare clear, concise and well-reasoned legal documents, including motions, briefs, memoranda, and legal opinions, in support of municipal prosecution and related legal matters.
Properly interpret and apply federal, state, and local laws, regulations and policies.
Communicate concisely and clearly, both orally and in writing.
Establish and maintain effective working relationships with those contacted in the course of work.
Understand and follow oral and written instructions.
QUALIFICATIONS FOR THE JOB
