Successful candidates include an experienced senior associate who can manage complex litigation projects independently and communicate directly with clients. An established book of business is helpful, but not necessary.
Responsibilities include:
* Detail oriented, self-starter litigation associate attorney with at least 2 - 5 years' experience and active Oregon bar license in good standing. Duties (with a progressive increase in responsibilities and independence with partner support and leadership;
* Represent clients in civil and probate court in matters involving financial elder abuse and breach of fiduciary duty claims, trust and will contests, elder abuse restraining orders, and in the appointment and removal of fiduciaries in probate, trust, and protective proceedings;
* Assist in all phases of litigation, including taking and defending depositions, negotiating settlements, attending mediations, preparing for trial (interview witnesses, identify and prepare potential exhibits, draft direct and cross examination questions), and appearing in court (status checks, ex parte, arguing motions, and trial);
* Draft pleadings and documents (memoranda; demand letters; pleadings including petitions, complaints, motions, declarations, judgments, notices, proofs of service; RFP's, RFA's, and responses; trust and estate accountings; settlement agreements);
* Communicate with clients to provide legal advice, discuss case strategy, facilitate client decision-making, and provide prompt and regular case updates;
* Communicate with opposing counsel, including conferrals and settlement negotiations;
* Participate in the development and implementation of case strategy;
* Conduct legal research and analysis;
* Gather, review, analyze, and produce discovery

The National Labor Relations Board (NLRB) has an important role to ensure workers can join unions and engage in concerted activities, such as requesting changes in working conditions. However, during the Biden-Harris administration, the NLRB has sought to expand its mandate through novel interpretations of the law.
For example, on October 7, General Counsel Jennifer Abruzzo issued a memo addressing non-compete agreements and "stay-or-pay" provisions. This builds on her May 2023 guidance, which expressed hostility toward these agreements, viewing them as overly restrictive under the National Labor Relations Act (NLRA).
Abruzzo's memo emphasizes her intention to prosecute employers who enforce non-compete and stay-or-pay provisions. She argues that non-compete agreements can deter employees from exercising their rights due to fear of repercussions, despite these agreements traditionally being governed by state law and not regulated under the NLRA.
She claims that non-compete agreements can be "self-enforcing," potentially limiting job mobility and suppressing wages, which she views as beyond the NLRB's mandate, especially if such agreements are voluntary. She advocates that employees should be free to waive their rights to pursue other employment opportunities.
Regarding stay-or-pay provisions, including training or educational repayment agreements and bonuses tied to mandatory stay periods, Abruzzo states these are used by employers to protect their investments in training. However, she argues these provisions can suppress union organizing and other activities by creating financial disincentives for employees to leave. She recommends that employers ensure these provisions are narrowly tailored.
The memo suggests remedies beyond rescinding unlawful provisions, advocating for "make-whole" relief to restore employees to the positions they would have held if the unlawful provisions had not existed.
For employers, Abruzzo's memo indicates her office will pursue a stringent approach in prosecuting violations, with significant penalties for breaches. Given the activist stance of the current NLRB majority, enforcement actions are increasingly likely.

POSITION SUMMARY:
These positions provide legal representation to prosecute individuals accused of crimes in District, Juvenile, or Superior Court. Civil deputies provide advice and representation to County departments and officials. The Deputy Prosecuting Attorney IV position is reserved for prosecutors handling civil and criminal cases of the highest degree of complexity and significance.
This is a career progression series opportunity. Employees are eligible for progression through the classification series based on attaining the minimum qualifications for each level and meeting performance measures.
ESSENTIAL FUNCTIONS:
The following duties are essential for this position. However, they are not to be construed as exclusive or all-inclusive. To be successful in this position, an individual must be able to perform each duty satisfactorily. Other duties may also be required or assigned.
ALL POSITIONS
* Reviews and evaluates factual and legal bases of cases filed to determine legal sufficiency. Directs further investigation as needed. If a criminal matter, makes charging decisions and prepares charges to be filed with County Clerk. In civil matters, consults with county policymakers as appropriate.
* Prepares cases through legal research, evidence review, witness interviews, and drafting legal documents; develops case strategy and organizes exhibits, questions, and arguments; prepares for and attends hearings and trials.
* Evaluates cases for appropriate disposition, conducts negotiations and plea or settlement discussions with opposing counsel, and maintains professional relationships to facilitate case resolution.
* Communicates with victims, witnesses, law enforcement, and other stakeholders as appropriate to provide information, coordinate participation, and connect individuals with services; collaborates with coworkers, other departments, and outside agencies.
* Works with the Division of Child Support to secure and enforce financial support obligations for children through legal advocacy and collection efforts. (Civil Division, Child Support).
* Assists and trains support staff as necessary.
* Performs other duties as assigned.
DPA I
* Under general direction, conducts legal proceedings; determines strategy, organization, evidence presentation, appearance of witnesses, and jury instructions.
* Under general direction, provides legal advice and representation to County departments and elected officials.
DPA II, III, IV
* Without need for significant direction, conducts legal proceedings; determines strategy, organization, evidence presentation, appearance of witnesses, and jury instructions.
* Without need for significant direction, provides civil legal advice and representations to County departments, elected officials. (Civil Division).
* Provides legal advice to law enforcement.
DPA III, IV
* Works closely with law enforcement officials to ensure thorough investigation of cases. (Criminal Division).
* Advises law enforcement agencies/officers on legal aspects of specific offenses and on proper arrest, search and seizure, and related policy/procedure/statutes; involves reviewing search warrants, attending briefings, and being available via phone/email during typical non-working hours. * Regularly handles matters of particular significance and/or complexity.
DPA IV
* Possesses a depth of experience and provides advice and guidance to other attorneys and staff in the office.

* Duties and responsibilities of the Prosecuting Attorney's Office.
