SUMMARY
Under general direction of the General Counsel, the Attorney IV performs a high volume of legal assignments of the most complex and sensitive nature. With respect to the duties below, the Attorney IV's work product is expected to require minimal revision from supervisory staff. Provides legal advice to the Department's executive staff, management, and program staff primarily in connection to licensing matters, including the most complex and sensitive matters. Incumbents respond orally and in written format to Department personnel, outside agencies, licensees, license applicants, and members of the public regarding licensing matters. Additionally, the Attorney IV advises Divisions, District Offices, and other Department personnel on pending licensing and protest matters, particularly with respect to tiedhouse laws and complex ownership structures. Duties also include working on regulations and legislative proposals as well as advising various Department units, including Human Resources and the Trade Enforcement Unit, regarding legal matters. Incumbents are expected to work with broad discretion and independence and to be expert in the complex area of law within the Department's legal program.

Working Conditions

Under the general direction of the Assistant Chief Counsel in the Tax Administration and Procedure Bureau, the incumbent assists in planning, organizing, directing, and coordinating the work of assigned staff in the Legal Division; the incumbent supervises a group of subordinate attorneys and other paraprofessional staff who perform a wide variety of legal work, with varying levels of complexity. Those activities may include interpreting laws, regulations and court decisions; handling taxpayer protests and appeals; representing the Department before various state administrative bodies, including the Office of Tax Appeals; acting as a liaison with the Office of the Attorney General in litigation; testifying before legislative and congressional committees; drafting and analyzing legislative proposals and bills; promulgating regulations and rendering advice with respect to other administrative matters, protests, appeals, litigation, rulings and regulations and special assignments involving the subject matter of the bureau. The Department of Financial Protection and Innovation (DFPI) is recruiting for one permanent, full-time Attorney III position in the Legal Division, Securities Regulation Unit to be located in the Sacramento, San Francisco, Los Angeles, or San Diego office. This recruitment may be used to fill subsequent vacancies of these positions within the next 180 days.
The DFPI is a California state agency that protects California consumers, small businesses, and investors, and administers multiple state licensing laws relating to financial services. Industries that the DFPI regulates include digital asset businesses; state-chartered banks, credit unions, and money transmitters; mortgage and student loan servicers; state-licensed lenders; investment advisors; and debt collectors. The DFPI often considers legal and policy issues presented by emerging financial technologies, and develops strategies that protect consumers and investors while encouraging financial innovation that benefits all Californians. Under the Legal Division, the Securities Regulation Unit is responsible for reviewing the offer and sale of securities in California and promoting investor protection while fostering innovation in California's financial marketplace.
The successful candidate will report to the Assistant Chief Counsel of the Securities Regulation Unit in the Legal Division. The primary responsibilities include reviewing and approving complex and sensitive securities applications, conducting public fairness hearings on securities transactions and issuing decisions in fairness hearings; and resolving compliance violations under the securities laws. The Civil Rights Department (CRD or Department) is the civil rights enforcement agency for the State of California. CRD's mission is to protect all people in California from employment, housing and public accommodation discrimination, human trafficking, and hate violence.
The CRD is the largest state civil rights enforcement agency in the country. Statement of Qualifications Instructions
A Statement of Qualifications (SOQ) is required and must be submitted with your application. Do not submit a cover letter or resume in lieu of the SOQ. The SOQ is a narrative discussion of how the candidate's education, training, experience, and skills meet the desirable qualifications and demonstrate the candidate's ability to perform the job duties listed in this bulletin. The SOQ serves as a documentation of each candidate's ability to present information clearly and concisely in writing.
When completing the SOQ, you must title the page "Statement of Qualifications" and include your name and the Job Control number at the top of each page. You must list each question, and provide your answer below each question. When completing the SOQ please include all relevant experience, education, and training for each question and explain your answers thoroughly. Your response to these questions should be no longer, cumulatively, than six pages in length, using double-spacing and 12-point Arial font. Your SOQ must address the following:
1. Describe your knowledge of the Civil Rights Department and its functions, and why you are interested in serving in this role.
2. Describe your experience in:
* Serving as a mediator in mediations in civil litigating or other matters\
* As an attorney for a party, mediating or litigating cases under the California Fair Employment and Housing Act (including employment cases), other laws that the Department enforces, or otherwise
* Working with unrepresented parties or with counsel on sensitive and difficult topics related to violence or systemic discrimination; and
* Any other experience that is relevant to this position.
3. Describe your experience researching and analyzing complex legal issues, including, if applicable, mediation ethics and California civil rights laws and public policy.
