The Public Safety Attorney III position provides intermediate-level litigation services for the Public Safety Section, primarily representing the Department of Adult Correction (DAC) in federal and state courts and in administrative hearings before the Office of Administrative Hearings (OAH). For Division of Mental Health (DMH), this attorney helps oversee the management of the Debt Referral Office, which is comprised of a paralegal who is contracted to DHHS to collect debt after DHHS' efforts have failed. This attorney assists in actions arising from the Debt Referral Office and in collections cases against the estates of deceased persons for costs associated with services provided at a DSOHF facility. This position counsels and provides assistance to DHHS on collections law and issues. This attorney will also handle a variety of appeals involving Medicare denials for reimbursement.
The attorney serves during the absence of the incumbent for commitment hearings and re-hearings for patients committed to a DSOHF facility and for patients who have been adjudicated as Not Guilty by Reason of Insanity in District and Superior Courts. This position may be assigned civil appeals arising out of commitments to any state, or privately operated facility designated for involuntary commitment.
Other responsibilities of this attorney may include representing DMH in OAH on appeals arising out of community mental health operations contracted via area authorities; representing DHHS agencies in matters arising out of state personnel grievances; and other matters representing DHHS as assigned by supervisors.

Qualifications
Minimum requirements are a J.D. from an accredited school of law and membership in good standing with the North Carolina Bar Association or be eligible to be admitted to the North Carolina Bar after selection. Also required is at least ten (10) years' experience as an Attorney, with at least five (5) years in the practice of local government law, ideally with a successful track record as a City/County Attorney, Deputy or Assistant City/County Attorney, or experience in a private law firm advising local governments with a full range of services.
Preferred qualifications include well-rounded experience in local government law, including tax/appraisals, public meetings and records, elections, public contracts, procurement, public safety, social services, employment law, land use, management of outside counsel, and litigation. Experience managing staff and working in a setting with a multi-cultural constituency is also preferred.

Inside the Organization
Guilford County operates under a Council-Manager form of government, with a nine-member Board of Commissioners appointing a professional County Manager to oversee the County's operations. The County Manager provides executive leadership, directing and supervising all County offices, departments, and agencies under the general control of the Board. As the Chief Administrator, the County Manager works closely with the Deputy County Manager and two Assistant County Managers. Together, the leadership team prepares and administers the County's annual budget and capital improvement program, advises the Board on fiscal and policy matters, and ensures the fair and effective implementation of the Board's policies, laws, and strategic goals.
For Fiscal Year 2025-2026, the County adopted an $847.3 million General Fund budget and employs approximately 3,032 personnel. The budget highlights the Board of Commissioners' commitment to education, public safety, and essential community services.
Some key funding allocations include:
* Education: $499.3 million allocated to Guilford County Schools (GCS) and Guilford Technical Community College (GTCC). GCS receives $467.6 million, including $282.5 million for operations, supporting the Board of Education's highest priorities. Funding also covers $87.8 million for existing and planned school debt, $47.3 million for future debt service on the $2.0 bond program, and $50.0 million for capital systems replacements and renovations funded with bond proceeds. GTCC receives $31.7 million, including $19.7 million for operations, $1.55 million for capital needs, and $10.4 million for debt obligations.
* Public Safety and County Services: The budget included restoring capital equipment replacement for public safety functions, and improving emergency medical response capability, by adding 24 positions within Emergency Services to support the addition of four (4) peak demand units. Additional funding supports the Sheriff's Office real-time crime center, reentry programs for incarcerated residents, and community initiatives such as the Family Justice Center, Camp HOPE, and the Tenant Education Advocacy Mediation (TEAM) program. Eight (8) positions were added to Animal Services to stabilize operations supporting the recently opened animal services center.
* Additional Limited Staffing Additions in Health and Human Services: Twenty-six (26) positions in Social Services Protective Services to support assessments and foster care, eight (8) in the Food and Nutrition Services Program, and three (3) in daycare services.
* Rural Fire Districts and Special Initiatives: Tax rates approved as requested by local fire district boards provide sustainable funding for personnel, equipment, and operational needs. Opioid Settlement Funds continue to be leveraged to address the opioid crisis.
The County is rated Aaa/AAA by Moody's and S&P, maintains a total fund balance of $334 million, and updated the County's compensation and total rewards plan in 2023. The County's tax rate is $0.7305 per $100 of assessed value.

The Guilford County Attorney's Office is a full-service internal law firm dedicated to providing proactive, sound, and ethical legal advice and representation to the Board of County Commissioners, the County Manager, and all County departments and related agencies. The office strives to provide outstanding counsel across the full spectrum of local government law, including litigation, constitutional law, contracts, open meetings, public records, purchasing, property tax assessment and collection, budget and financial procedures, and personnel matters. This robust mandate requires the team to serve a variety of clients with offices in both Greensboro and High Point, where the two courts are located.
The Community
Founded in 1771, Guilford County is the third-most populous county in North Carolina. Guilford County was named after Francis North, the first Earl of Guilford, and was formed from parts of Rowan and Orange Counties to centralize government and the Courts of Guilford. OPLA is the largest legal program in the Department of Homeland Security (DHS), employing over 1,700 attorneys nationwide. In addition to Headquarters in Washington, D.C., there are 24 OPLA Field Locations in more than 60 cities throughout the United States. Pursuant to statute, OPLA serves as the exclusive representative of DHS in removal proceedings before the Executive Office for Immigration Review litigating cases involving criminal aliens, terrorists, human rights violators, and other priority aliens. OPLA also provides a full range of legal services to all ICE programs and offices.
OPLA attorneys provide legal advice and prudential counsel to ICE personnel on their law enforcement authorities, legal liability under the Federal Tort Claims Act and Bivens v. Six Unknown Named Agents of Fed. Bureau of Narcotics, 403 U.S. 388 (1971), the Freedom of Information Act and Privacy Act, ethics, and a range of administrative law issues, such as contract, fiscal and employment law. OPLA attorneys represent the agency before the Merit Systems Protection Board, the Equal Employment Opportunity Commission, and the Contract Board of Appeals. OPLA attorneys support the Department of Justice in the prosecution of ICE cases and in the defense of civil cases against ICE.
The selected attorney will immediately be given significant responsibilities and will be expected to craft legally supportable policies to address the needs of agency operational components. The attorney will be expected to routinely provide timely legal opinions to ICE officers and agents, management, and leadership within OPLA, ICE, and DHS's Office of the General Counsel Headquarters. The selected attorney will be required to assess litigation risk and provide litigation support to the Department of Justice.
As a General Attorney, you will perform the following duties at the full performance level:
* Represent the United States Government in removal proceedings before immigration judges, frequently involving applicants for asylum or for other forms of relief under immigration laws;
* Provide expert legal counsel in the interpretation of highly complex immigration and customs laws including comprehensive and in-depth knowledge of statutory, regulatory and case authorities;
* Prepare cases for litigation by conducting legal research; prepare pleadings, motions, briefs, stipulations, affidavits, and other legal documents;
* Prepare witnesses for litigation; conduct direct examination and cross examination; present oral arguments advancing ICE's legal position; negotiate the disposition of cases with opposing counsel; and advise the Chief Counsel and/or Deputy Chief Counsel on cases potentially warranting deferred action or other exercise of prosecutorial discretion;
* Construct litigation reports for United States Attorney's Offices on civil matters pending in the federal courts involving ICE, and serve as liaison between Department of Justice's Office of Immigration Litigation and the local Enforcement and Removal Field Office on immigration matters pending in the Circuit Courts of Appeals;
* Provide legal advice and support to the other ICE components and litigation support to United States Attorney's Offices in immigration and/or customs matters. The position also involves appellate advocacy before the Board of Immigration Appeals, including the preparation of briefs and other pleadings.

OPLA is the largest legal program in the Department of Homeland Security (DHS), employing over 1,700 attorneys nationwide. In addition to Headquarters in Washington, D.C., there are 24 OPLA Field Locations in more than 60 cities throughout the United States. Pursuant to statute, OPLA serves as the exclusive representative of DHS in removal proceedings before the Executive Office for Immigration Review litigating cases involving criminal aliens, terrorists, human rights violators, and other priority aliens. OPLA also provides a full range of legal services to all ICE programs and offices.
OPLA attorneys provide legal advice and prudential counsel to ICE personnel on their law enforcement authorities, legal liability under the Federal Tort Claims Act and Bivens v. Six Unknown Named Agents of Fed. Bureau of Narcotics, 403 U.S. 388 (1971), the Freedom of Information Act and Privacy Act, ethics, and a range of administrative law issues, such as contract, fiscal and employment law. OPLA attorneys represent the agency before the Merit Systems Protection Board, the Equal Employment Opportunity Commission, and the Contract Board of Appeals. OPLA attorneys support the Department of Justice in the prosecution of ICE cases and in the defense of civil cases against ICE.
The selected attorney will immediately be given significant responsibilities and will be expected to craft legally supportable policies to address the needs of agency operational components. The attorney will be expected to routinely provide timely legal opinions to ICE officers and agents, management, and leadership within OPLA, ICE, and DHS's Office of the General Counsel Headquarters. The selected attorney will be required to assess litigation risk and provide litigation support to the Department of Justice.
As a General Attorney, you will perform the following duties at the full performance level:
* Represent the United States Government in removal proceedings before immigration judges, frequently involving applicants for asylum or for other forms of relief under immigration laws;
* Provide expert legal counsel in the interpretation of highly complex immigration and customs laws including comprehensive and in-depth knowledge of statutory, regulatory and case authorities;
* Prepare cases for litigation by conducting legal research; prepare pleadings, motions, briefs, stipulations, affidavits, and other legal documents;
* Prepare witnesses for litigation; conduct direct examination and cross examination; present oral arguments advancing ICE's legal position; negotiate the disposition of cases with opposing counsel; and advise the Chief Counsel and/or Deputy Chief Counsel on cases potentially warranting deferred action or other exercise of prosecutorial discretion;
* Construct litigation reports for United States Attorney's Offices on civil matters pending in the federal courts involving ICE, and serve as liaison between Department of Justice's Office of Immigration Litigation and the local Enforcement and Removal Field Office on immigration matters pending in the Circuit Courts of Appeals;
* Provide legal advice and support to the other ICE components and litigation support to United States Attorney's Offices in immigration and/or customs matters. The position also involves appellate advocacy before the Board of Immigration Appeals, including the preparation of briefs and other pleadings.

This position will:
* Assign criminal appeals in the North Carolina Appellate Courts to North Carolina Department of Justice attorneys who are on the brief rotation.
* Review and summarize all North Carolina appellate court decisions.
* Represent the State of North Carolina in criminal appellate cases by researching legal issues and law, drafting briefs, motions, motion responses, petitions, petition responses and other filings in the North Carolina and federal appellate courts.
* Ensure consistency and fairness in appellate advocacy by tracking relevant precedent, and helping to oversee coordinated, strategic approach to the State's positions in appellate courts.
* Collect, track and maintain data metrics for all North Carolina criminal appeals and criminal appellate case assignments to attorneys on the criminal brief rotation.
* Contact the designated District Attorney, District Attorney representative or Departmental attorney regarding their criminal appellate cases.
* Assist North Carolina Department of Justice attorneys and state District Attorneys with criminal appeals.
* Provide appellate advocacy training and legal resources to North Carolina Department of Justice attorneys and criminal justice stakeholders.
* Review prospective State's appeals.
* Maintain a victim notification system for criminal appellate cases.

The Appellate and Post-Conviction Section of the Criminal Division of the North Carolina Department of Justice is to represent the State in criminal matters after a defendant's trial is completed. This includes: (1) direct appeals of criminal convictions in any of the judicial districts of the State before the North Carolina Court of Appeals and the Supreme Court of North Carolina as well as state post-conviction petitions filed in the State Appellate Courts;(2) to research and prepare the State's briefs and present oral argument in federal habeas corpus litigation in the federal district courts and the Fourth Circuit Court of Appeals; (3)the attorneys in the section handle the most difficult and complex criminal appeals and petitions, and therefore, because of their expertise, also serve as resources for all of the attorneys in the Department of Justice who handle occasional criminal appeals as part of their duties through the criminal brief rotation; (4) the section attorneys also represent the State of North Carolina in capital (death penalty) litigation, particularly at the state and federal post-conviction levels before the North Carolina Supreme Court, the Supreme Court of the United States, and the lower federal courts; (5) assist District Attorneys in all aspects of such state capital litigation, both at trial and in post-conviction proceedings; (6) act as liaison with Attorneys General and prosecutors on criminal law issues; (7) the section attorneys represent the State in non-capital state post-conviction petitions filed upon request of the District Attorneys and approval of the Criminal Bureau Chief; (8) the section also has the responsibility to defend against non-capital federal habeas corpus actions filed in federal courts by State prisoners seeking to overturn their North Carolina state court convictions, and thereby prevent expensive and time-consuming retrials or the premature release of criminals who cannot be retried.

Confers with supervisor, defense attorneys, investigators, law enforcement officials, victims, witnesses and other parties concerning assigned cases.
Prosecutes cases before appropriate court and/or jury.
Responds to correspondence from persons making inquiry to or requesting information from the department.
May conduct juvenile hearings or state mental commitment hearings.
Assists clerical and legal secretarial staff as needed.
May assign and review the work of clerical and secretarial staff on the processing of an assigned case.
Confers with paralegals regarding assigned cases.
Compiles statistical reports.
Utilizes the computer to process, retrieve and disseminate information.
Prosecutes cases or assists in the prosecution of cases in Justice of the Peace Courts and/or County Courts-at-Law.
Interviews witnesses and prepares clients for court hearings.
May write appellate briefs.
Performs criminal intake including reviewing files, interviewing complainants or victims and performing investigations.
Performs such other duties as may be assigned.
SUPERVISORY RESPONSIBILITIES:
Does not supervise other employees; but may assign and review work of Paralegals and Legal Secretaries.
