Responsible for ensuring prospective carriers meet minimum contracting conditions including safety and insurance requirements of J.B. Hunt and the DOT. + Assist with gathering necessary items from carrier to expedite the onboarding process
+ Track leads for new carriers that could develop into a working relationship to drive external capacity growth
+ Meet or exceed departmental goals for outbound calls, financial returns, and/or capacity growth
+ Explain the process to be an approved carrier and maintain status of activity in the qualification process within the company's outsource capacity database
+ Evaluate and determine whether prospective carriers meet minimum contracting conditions including insurance and safety requirements of J.B. Hunt and the DOT through a prescribed qualification process utilizing carrier management tools such as Safersys and internal partners such as Corporate Safety
+ Create and deliver marketing materials and sales presentations to communicate and demonstrate the value and benefits of our diversified business model for carriers to partner with the J.B. Hunt network in order to increase carrier base
+ Build relationships via cold-calling, email, and online databases with potential carriers by explaining the value of carrying with J.B. Hunt in order to create and maintain a pipeline of contacts. Focus is on developing relationships with big carriers by physical cold-calling and relationship negotiation

This incumbent will work closely with internal and external contacts to investigate claims, negotiate settlements, and prepare reports to ensure accurate and timely processing of casualty claims. This role will serve as a team lead to less experienced team members, lead initiatives when claims should be escalated to additional professionals, and provide settlement authority within designated limits to promote efficient resolutions.

Key Responsibilities:
Utilize independent knowledge and experience to conduct claims investigations to determine liability exposure of each assigned claim. This investigation includes analysis of state and federal laws, retaining services of field investigators, outside legal counsel to obtain a full picture of exposure and documentation of all findings for each claim within the claims matter management system for management review as well as internal and external audit processes.
Manage significant to catastrophic claims involving alleged property damage and bodily injury through the interview of key witnesses, securing evidence, reviewing applicable statutes and laws, analysis of estimates of repair, and analyzing medical reports
Handle all monetary aspects of assigned claims through the calculation of financial exposure analysis leading to the establishment of reserves at proper levels within assigned approval levels. And, by keeping management aware of claims with exposures above approved levels for continuous timely and efficient resolutions of assigned claims.
Manage negotiations with claimants, claimant's legal representatives or third parties by utilizing strong communication and negotiation skills in sharing investigative results and rationale, listening to claimant perspective and arguments and influencing claimant perspective to achieve consensus on appropriate and final resolution of assigned claims.
Utilize strong communication skills to keep all stakeholders aware of findings, decisions, and resolutions to support plans and initiatives to meet business unit needs while establishing accountability in achieving results and identifying and addressing improvement opportunities.
Prioritize and manage assigned claims workload to keep all involved parties informed and provide timely claims status updates
Initiate prompt contact with claimants to obtain information and establish the claims process; process incoming calls, emails, and notifications to support workload surges and/or extenuating situations including the creation of accident reports from the accident hotline.
Collect and analyze data from internal departments and third-parties to create repair estimates for company equipment to subrogate against adverse parties; present collected data to adverse party for collection or reimbursement of damages
Ensure compliance with company and departmental policies and procedures that support the mission, values and standards of ethics and integrity of the company
Pursue continual education in the practice of transportation claims management through internal training, seminars, and other educational materials to stay abreast of the changing claims and legal environment
Retain and manage outside counsel to assist in the investigation, preservation, and documentation of any significant to catastrophic claims. Utilizing independent knowledge and experience to interpret legal guidance in forming personal evaluations of claims from a liability and financial exposure standpoint.
Retain and manage outside counsel in the defense of matters in which the company has been named in legal proceedings. Utilizing the guidance and legal opinion of outside counsel in assisting to form the defense of these litigated matters as well as the potential path to resolution.
Provide training and mentoring to Claims Examiner I and II roles within the Casualty team to assist with onboarding of new team members; support through approval of additional settlement and reserving authority levels and in the assistance of claims resolution

Full time Under general supervision, the Litigation Counsel plays a crucial role in the legal process by thoroughly investigating, reviewing and assessing claims and legal cases to ensure compliance with applicable laws and regulations. The incumbent conducts legal research and coaches junior team members. Assignments are broad in nature, usually requiring originality and ingenuity. The position works closely with attorneys and other legal professionals to support the successful resolution of claims and litigation matters.

Key Responsibilities:
Analyze and assist junior team members with legal claims and cases to determine their validity and potential for resolution through litigation or alternative dispute resolution methods; consult senior team members as needed
Examine legal documents, contracts, evidence, and related materials to identify key issues, facts, and legal arguments
Conduct research on applicable laws, regulations, and precedents to provide valuable insights and recommendations to legal teams
Ensure that all litigation activities and strategies comply with relevant laws, regulations, and internal policies
Prepare and assist junior team members with comprehensive reports summarizing findings, assessments, and recommendations for further action, providing clear and concise information to attorneys and management
Collaborate with attorneys, paralegals, and other legal professionals to discuss case strategies and provide expertise on litigation matters
Assist in coordinating witness interviews, depositions, and testimony, ensuring that all necessary documentation and information are prepared.
Oversee the management and organization of case files, evidence, and exhibits, maintaining accurate records and ensuring document retention compliance
Provide support during trial proceedings, including, but not limited to, organizing exhibits, witnesses, and assisting in courtroom activities as needed
Remain updated on changes in relevant laws and regulations and engage in ongoing professional development to enhance litigation examiner skills
Facilitate the investigation of accidents and losses, including, but not limited to, the assignment of local counsel and other support vendors to determine the exposure
Participate in a rotating on-call program to provide support outside of regular business hours
Responsibilities may require travel on short notice to assist in the investigation of accidents and losses.

Qualifications:
Minimum Qualifications:
Juris Doctorate from an accredited Law School with Less than 1 year of managing claims, litigation, transportation, or relevant experience, and/or military equivalent. Licensed to practice law (and in good standing) in at least one jurisdiction

Preferred Qualifications:
Bachelors in Business Administration, Transportation/Logistics, Supply Chain, Marketing or related field.
AND 1-2 years of experience in transportation/logistics, business administration, account management, sales, marketing and/or equivalent military experience.

Factors which may affect starting pay within this range may include skills, education, experience, geography, and other qualifications of the successful candidate. This position may be eligible for annual bonus and incentives based on profitability or volumes in accordance with the terms of the Company's bonus and incentive plans, as applicable and in effect from time to time.
