The Litigation Bureau represents the Commissioner in tax‑related litigation matters before the Appellate Tax Board and various state and federal courts, including the United States Bankruptcy Court, Massachusetts Appeals Court and the Supreme Judicial Court (under the appointment of the Department's General Counsel as a Special Assistant Attorney General). The Department seeks a Counsel I for its Litigation Bureau. This is a junior‑level trial attorney position. The incumbent will represent the Department in proceedings before the Appellate Tax Board and various courts both as lead counsel in low to moderate dollar value cases, and as second seat with more senior tax attorneys in multimillion‑dollar tax litigation. The Bureau works in a hybrid model (part remote and part in‑office in Boston).
Duties and Responsibilities (these duties are a general summary and not all inclusive):
Handle Appellate Tax Board (“ATB”) cases in which the dollar value of an individual case does not exceed a defined dollar value, as well as cases of similar value in state and federal (mainly bankruptcy) courts.
Negotiate with opposing parties when appropriate, to reach resolution based on relative merits of case and hazards of litigation.
With regular supervision, argue motions and litigate cases that cannot be settled or otherwise resolved.
Provide functional direction, guidance, instruction, and delegation of tasks to interns, support staff, or other personnel; and participate in the training and mentoring of new employees.
Obtain information needed to represent the agency in litigation matters by conducting research and analysis of the applicable laws, statutes, and regulations, and by reviewing cases, files, case history, and evidence submitted by opposing parties to understand the facts and issues and to determine the best course of action.
Assist other Litigation Bureau attorneys with their respective cases; may participate in major ATB appeals with senior staff attorneys (Tax Counsels and Counsel IIs) on their assigned cases.
Assist other Divisions within the Department when they seek certain legal advice or action including, but not limited to: seizure referrals; license revocations; contract actions; and opposition and/or cooperation with regard to certain subpoenas and summonses. Participate in drafting new or amended policies related to these functions to ensure compliance with laws.
As assigned, collaborate with other agencies or stakeholders to share information, resolve issues or work on cross‑functional initiatives to meet shared goals.

Division Overview
The mission of the Department of Revenue's Child Support Services Division is to enhance the well-being of children by partnering with parents and caregivers to meet the financial needs of the family. Effective child support services are an essential part of the larger effort by the Commonwealth and the federal government to promote families' economic self-sufficiency.
DOR/CSE's core functions are to establish parentage, and establish, enforce and modify child support and health insurance orders. Much of our success depends on collaborations with a wide variety of state agencies and private entities.
The Massachusetts Department of Revenue's Child Support Services Division seeks an attorney for a Counsel I position for the Litigation team in its Northern Region office located in Woburn.
DOR/CSS utilizes a hybrid work model where employees work both in-office and remotely, depending on operational needs. Candidates must ensure they have the appropriate work environment for telework, including but not limited to, connectivity, and resource access to conduct their job duties while remote. Candidates must be able to supervise and be supervised remotely and must be able to work effectively in an isolated setting. Candidates must be organized, highly disciplined, conscientious, motivated, and committed to utilizing identified tools for successfully performing in a remote setting. Candidates must be available to travel to their officially designated work location with as little notice as the same workday should an exigent circumstance arise.
Duties:
· Assess, draft, and file/efile legal pleadings in various divisions of the Probate and Family Court Department.
· Manage a high-volume litigation caseload to support the financial needs of the family and to ensure compliance with statutory and procedural requirements, state and federal timelines for health insurance, and agency policies and procedures.
· Prepare for virtual case conferencing sessions and/or virtual court hearings\: including conferring with regional staff to obtain necessary case information and documents; perform necessary legal research and analysis; prepare case summaries; and organize case information.
· Appear at virtual case conferencing sessions and/or virtual court hearings to establish legal paternity; establish, modify and enforce orders for child support and health insurance; and address customer issues.
· Review case inventory on a regular and consistent basis to control inventory and minimize backlogs; and refer cases to appropriate regional staff when legal action is not pursuable.
· Report to supervisor concerning backlogs, including identifying problem cases, proposed solutions; and developing strategies to eliminate backlogs.
· Update CSS's case management system (COMETS HD) and other case tracking systems with actions taken.
· Advocate DOR's interests in a legally sound manner by correctly interpreting and applying state and federal laws, statutes and regulations regarding child support services, and agency policies.
· Determine the best means to inform customers concerning what actions the agency will or will not take on their cases, risks (including physical or emotional risks related to domestic violence/family safety), time frames, and what actions the customer needs to take to cooperate with the agency.
· Identify means to resolve disputes between customers and the agency.
· Serve as in house CSS counsel by responding to inquiries from internal and external CSS customers, including, but not limited to, providing legal case consultation to CSS managers and staff; informing judges, private counsel, and other customers of DOR policy and procedures; and delivering quality legal services to CSS litigants.
· Treat litigants with dignity and respect at all times; and handle confrontation in a professional manner.
· Promote and foster a positive image of the agency and its representatives.
· Participate in training and professional development opportunities.
· Participate in state-wide workgroups and special projects.
Qualifications
· Member in good standing with the Massachusetts Bar.
· Knowledge of theory, principles, and practices of law
· Knowledge of procedures followed in courtroom and administrative proceedings.
· Experience in family law/domestic relations.
· Knowledge of the methods and ability to conduct legal research and write reports.
· Ability to read and interpret legal documents, and apply the law, rules and regulations governing operations.
· Strong research and oral advocacy skills.
· Ability to communicate effectively orally and in writing, and to clearly and concisely express thoughts and develop ideas in a logical manner.
· Ability to exercise discretion and sound judgment, and handle confidential assignments.
· Ability to interact effectively with diverse groups of people.
· Ability to convey information and explain actions to customers with varying expectations, needs, cultures, and languages.
· Ability to work independently and under pressure in high volume office and court environments.
· Ability to use a computer to conduct research, manage databases, and produce written documents.

MINIMUM ENTRANCE REQUIREMENTS\: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and some experience in legal research, legal writing, and legal procedures and processes.

The Compliance Counsel is responsible for both the oversight of the Compliance Program and the provision of legal counsel on corporate matters. This role is split evenly, with approximately 50% of time dedicated to compliance activities and 50% to broader corporate legal responsibilities.
The Compliance Counsel provides guidance, policies, and advice to the RiverStone Executive Committee, Boards of Directors, Managers, senior management, and associates, ensuring maximum compliance with regulatory requirements and company policies, while also supporting corporate legal initiatives, contract review, and risk management.
The Compliance Counsel oversees the Compliance Program, which provides an independent and objective framework to review and evaluate compliance issues/concerns within the organization. The Compliance Program is intended to ensure support of maximum compliance with the rules and regulations of regulatory agencies, and RiverStone and Fairfax policies and procedures, with particular emphasis on the RiverStone Code of Conduct. The Compliance Counsel is empowered to take appropriate steps and elevate issues within RiverStone to advance the achievement of the objectives of an effective compliance program and facilitate the management of the compliance activities.
The Compliance Counsel also serves as counsel to RiverStone for corporate legal matters more generally. As detailed below, this will include a variety of responsibilities to support and implement corporate legal initiatives, contract review, and risk management.
Essential Functions
Compliance Responsibilities (50%)
Develops, initiates, maintains, and revises policies and procedures for the Compliance Program and its related activities to prevent illegal, unethical, or improper conduct.
Reviews and updates, as warranted, compliance policies, including the company Code of Conduct, to ensure continuing relevance and consistency in providing guidance across the organization. Works closely with General Counsel, HR, ExCo, and, where necessary, Fairfax contacts, to ensure consistency across compliance policies.
Manages day-to-day operation of the Compliance Program, implementing controls and metrics manage compliance exposures.
Collaborates with other departments, in particular Corporate Audit Services, to identify and mitigate compliance issues and utilizes appropriate channels for investigation and resolution. Consults with internal and, as appropriate, external attorneys as needed to resolve legal compliance issues.
Responds to reported or potential violations of rules, regulations, policies, procedures, and Code of Conduct, liaising with HR where appropriate.
Develops and manages a system for fair and (where possible) uniform handling of any policy violations and related investigations.
Oversees overall compliance with Records Retention policy, and works with records management to ensure adherence to policy in the handling of corporate records.
Identifies regulatory and other external issues and trends, recommending actions to smitigate potentially new compliance exposures.
Provides reports on a quarterly basis, or as required, to keep the Executive Committee and appropriate Board and senior management informed of the operation and progress of the Compliance Program.
Oversees and ensures proper reporting of violations or potential violations as required by law.
Institutes and maintains an effective compliance communication program for the promotion of compliance awareness throughout RiverStone, including use of the Ethics (or “whistleblower”) Hotline and training programs for associates.
Corporate Legal Responsibilities (50%)
Provides legal counsel on corporate matters, including contracts, transactions, and risk management.
Drafts, reviews, and negotiates contracts and other legal documents, advising internal stakeholders concerning such matters and representing RiverStone with external parties.
Reviews and manages various regulatory matters, including regulatory applications and approvals, coordination of regulatory examinations, and responses to complaints received from state departments of insurance.
Advises on regulatory, legislative, and legal issues affecting the conduct and operation of the business.
Supports internal investigations and dispute resolution.
Leads on matters associated with effective corporate governance, board matters, and legal entity management.
Liaises with external counsel as needed for specialized legal matters.
Undertakes legal research and prepares memoranda on issues related to the management of corporate matters.
Supports the development and delivery of legal training for associates.
Experience
· Minimum 8 years of experience in a legal and compliance role for an insurance company, or providing legal and compliance advice to financial services institutions.
· Insurance company experience and understanding of corporate compliance and regulatory issues.
Required Education
Four-year college degree, plus Juris Doctor.
Supervisory Role
For the foreseeable future, this position will not have direct reports.
