Able to transition from courts of limited exposure to courts of unlimited exposure. Develops and applies skills to control all aspects of litigation, including trial preparation, discovery, negotiation, presentation and appeals from District to Circuit Court. Primary Duties and Responsibilities (details of the basic job functions): Reviews and analyzes files, insurance policies, all allegations and pertinent medical and technical data. Consults with medical and accident reconstruction specialists regarding injuries and disabilities. Prepares responses to civil complaints, files and answers any appropriate motions when questions of law or liability are in dispute. Determines feasibility of including third-party defendants in pending suits. Selects legal investigators and arranges for service of subpoenas and summonses. Files additional motions as facts of case and proper timing warrant. Conducts discovery depositions; formulates interrogatories. Under moderate supervision of a Practice Leader, conducts examinations under oath. Analyzes information obtained through discovery and determines whether settlement is appropriate within his/her authority according to the Company guidelines. Prepares case for trial, examining facts and developing trial strategy for construction of a strong defense. Participates in jury selection. Advises insured and refers to independent counsel to protect insured's assets in event of an "over-limits" judgment as required. Coordinates trial or settlement activity with co-counsel, as necessary, to protect interest of insured. Negotiates reasonable and equitable pre-trial settlements on behalf of Company and insured, when and where possible. Consults with senior-level Attorneys on more complex cases when necessary. Recommends to Appeals Committee whether judgments should be appealed based upon facts of cases and chances of recovery. DESCRIPTION OF PROGRAM: Farmworker Legal Services (FLS) is a growing and nationally recognized non-profit law office and the statewide division of the Michigan Advocacy Program (MAP) that fights for justice and dignity alongside the farmworker community through our systemic, multi-forum community engagement and direct legal representation of farmworkers in their civil legal matters. FLS currently has 12 full-time staff positions based out of our Kalamazoo, Grand Rapids, and Ypsilanti (Ann Arbor area) offices and hires around 8 seasonal advocates each summer. FLS attorneys litigate complex wage and hour, multi-party employment, discrimination, and human trafficking cases in Michigan state and federal courts and provide a full range of civil legal services to Michigan's eligible population of farmworkers and their dependents in matters such as: housing, T or U-visa applications for victims of employment-based crimes, workers' compensation, public benefits, workplace health and safety, and unemployment administrative proceedings. MAP works to advance the safety, independence, and economic stability of those most affected by poverty, racism, and other structurally oppressive systems by increasing access to justice and working for systemic solutions and has a staff of about 220 people in offices in Battle Creek, Jackson, Kalamazoo, Lansing, Grand Rapids, Monroe, and Ypsilanti. Law Clerks can expect a highly educational, challenging, and rewarding experience as they work with FLS staff and Michigan's farmworker population at the intersection of their employment and immigration cases. Clerks will handle cases involving impact litigation, employment rights, and immigration relief. Clerks should expect to gain experience conducting client interviews, drafting pleadings and written discovery, providing educational seminars for client communities, conducting legal research, attending court hearings or depositions, assessing legal problems, and conveying legal advice through oral and written communication.
