The Legal Aid Society of Mid-New York, Inc. (LASMNY) is a non-profit public interest law firm. We provide free legal information, advice and representation to people who are unable to afford a lawyer. Our staff provides services in the following, thirteen counties: Broome, Chenango, Cayuga, Cortland, Delaware, Herkimer, Jefferson, Lewis, Madison, Oneida, Onondaga, Oswego, and Otsego. In addition, our Agricultural Worker Program (AWP) services the entire New York State.
MISSION STATEMENT
LASMNY's mission is to provide free legal assistance to low-income people facing civil legal problems that impact the basic needs of life. Through legal advice, emergency legal services and legal representation, we help low-income people stabilize their finances, protect themselves and their children from domestic violence, obtain access to healthcare, avoid homelessness as a result of wrongful evictions, protect the family home from foreclosure and increase household income. We also target specific vulnerable populations with our services, such as senior citizens, victims of domestic violence, people with disabilities, refugees and immigrants, and veterans.
JOB SUMMARY
The Staff Attorney provides representation in appeals matters for our Eviction Defense Program. Demonstrates an understanding and commitment to LASMNY's mission and value of justice. This position reports to the Deputy Director for Program Services.
ESSENTIAL JOB FUNCTIONS
Draft motions to reargue and/or reconsider local court summary eviction and repair decisions when clear errors exist.
Appeal local court summary eviction and repair decisions to higher courts.
Negotiate stipulations relating to appellate issues such as briefing schedules and the content of appellate records.
Conduct legal research for tenant defense unit, assisting with ongoing litigation.
Provide motion assistance to tenant defense unit, including motions to dismiss and motions for discovery.
Train tenant defense unit on how to create a good record for appeal.
Co-counsel complex affirmative litigation cases with tenant defense attorneys.
Independently manage a caseload.
Maintain accurate records and statistics for the coordination of timely reports.
Manage data related to grant reporting process.
Accurately and timely record billable time and case notes in our case management system.
Work professionally and collaboratively with colleagues, judges, opposing counsel, court personnel, community members, bar associations, etc.
Show commitment to professional growth in diverse areas of law.
Keep up with knowledge of legal developments including completion of Continuing Legal Education (CLE) courses.
Engage in outreach and education efforts to reach community members, advocates, and service providers.
Attend and participate in meetings and trainings as required.
Regular and predictable attendance.
Comply with all Legal Services Corporation (LSC) and LASMNY regulations, policies, and procedures, to include but not limited to the Case Management Policy and grant based reporting requirements.
Perform responsibilities and duties based upon agency needs and requirements as assigned by the supervisor.
JOB QUALIFICATIONS
Law degree from an accredited law school.
Law journal experience preferred.
Licensed to practice in NYS or eligible for admission on motion.
Prior legal services, trial and litigation experience preferred.
Demonstrated commitment to serving indigent community members is preferred.
Proficient with Microsoft Office or related software and computerized legal research.
Fluency in other languages a plus.
Valid NYS Driver's License or ability to obtain one if required.

Maintain a full-time caseload representing eligible clients served by our Fair Housing Unit.
Develop and maintain specialized knowledge in fair housing matters, including both federal and state fair housing protections.
Provide legal services to low income clients and client groups regarding these matters including advice, negotiation, litigation in federal and state courts, and representation in administrative forums including HUD and the New York Division of Human Rights.
Interact respectfully with clients from a wide range of backgrounds, with an awareness of the importance of cultural competence and humility.
Collaborate with other LawNY advocates, human services providers, non-profit organizations and community groups as well as the courts, administrative tribunals and the private bar to address legal problems within our community, including providing community legal education.

Staff Attorney - Housing Protection and Community Reinvestment

The Bath office of LawNY seeks to fill an immediate opening for a full time Staff Attorney working regionally on housing preservation and community reinvestment advocacy. The Staff Attorney will provide direct legal services across a range of housing cases, including representation of low-income tenants in landlord-tenant matters and representation of homeowners in mortgage and tax foreclosure litigation, Chapter 13 bankruptcy proceedings, and land contract/rent-to-own disputes. The Staff Attorney may also handle government benefits, substandard conditions issues, and subsidized housing matters as they relate to homelessness prevention cases. This position is a quasi-regional position to represent tenants in Steuben and Allegany Counties, and homeowners primarily in Steuben and Allegany Counties, but with a few cases representing homeowners in Chautauqua and Cattaraugus Counties, as well as to provide regional CRA advocacy.
Additionally, the Staff Attorney will have the opportunity to participate in a special regional project focused on advocacy under the Community Reinvestment Act (CRA) in Western New York. This project emphasizes advocating alongside other organizations and agencies for greater investment in regional community development projects (such as affordable housing) and working with regional banks to increase rural residents' access to financial services, low-interest mortgages, and loans. The CRA project is aimed at reversing the impacts of redlining and disinvestment in low-income Western New York communities and communities of color. This innovative project allows the staff attorney to advocate for long-range solutions to root cause issues that impact LawNY's client communities.

COMPENSATION PACKAGE
The beginning salary for a Staff Attorney at LawNY with no experience is $70,000 and the salary for a Staff Attorney with thirty years of experience is $106,100. Salary will be based on experience. LawNY is a qualifying employer for the Public Service Loan Forgiveness program(PSLF).

Maintain a full-time caseload representing eligible clients served by our Housing and Homeownership Protection Units
Develop and maintain specialized knowledge in housing matters, particularly: mortgage and tax foreclosures, manufactured home parks, land contracts, landlord-tenant, habitability issues, subsidized housing, bankruptcy, government benefits, and local community reinvestment issues.
Provide legal services to low income clients and client groups regarding these matters including advice, negotiation, litigation and administrative advocacy.
Interact respectfully with clients from a wide range of backgrounds, with an awareness of the importance of cultural competence and humility.
Collaborate with other LawNY advocates, human services providers, non-profit organizations and community groups as well as the courts, administrative tribunals and the private bar to address legal problems within our community, including providing community legal education.
Contribute to a safe and healthy work environment for fellow employees.
Cooperate in all grant reporting requirements, program reporting, timekeeping, file maintenance, case closing and compliance review.
Maintain a high level of professional competence through attendance of training sessions, seminars and conferences and individual efforts to keep abreast of current developments in the area of poverty law and the application of an equity lens to client service.

THE OPPORTUNITY:
New York City's Right to Counsel law, passed in 2017 after a successful tenant-led campaign by tenant organizers, advocacy groups and legal services organizations, is the first law in the nation to provide income-eligible tenants who are sued for eviction in housing court with the right to an attorney to defend their case.
LSNYC's housing practice helps realize this promise of this law and represents low-income tenants defending their homes. Our litigators defend tenants in many different settings, including in eviction proceedings in housing court, representing tenants in administrative hearings, bringing affirmative litigation, and handling appeals at all levels.
The work of RTC Housing Unit attorneys will involve developing expertise in housing court practice, housing programs and subsidies, and public benefits. The attorneys will be expected to perform community outreach and provide legal information, advice, and counsel, both in clinical and informal settings. The attorneys will also be expected to perform trainings for other advocates, tenant associations, community members, and community groups. We are looking for candidates who are excited to work in a fast-paced environment and to use creative strategies in the pursuit of justice.
The anticipated start date of this position will be September 8, 2025.
Salary & Compensation
Salary is pursuant to our collective bargaining agreement. Salary Range (based on years' experience) is as follows:
1-10 years: $85,612 - $110,424
11-20 years: $112,950 - $133,347

COMPENSATION PACKAGE
The beginning salary for a Staff Attorney at LawNY with no experience is $70,000 and the salary for a Staff Attorney with thirty years of experience is $106,100. Salary will be based on experience. LawNY is a qualifying employer for the Public Service Loan Forgiveness program(PSLF).

RESPONSIBILITIES

Maintain a full-time caseload representing eligible clients served by our Housing Unit.
Develop and maintain specialized knowledge in housing matters, particularly: landlord-tenant, subsidized housing, and government benefits.
Provides legal services to low income clients and client groups regarding these matters including advice, negotiation, litigation and administrative advocacy.
Interacts respectfully with clients from a wide range of backgrounds, with an awareness of the importance of cultural competence and humility.
Collaborates with other LawNY advocates, human services providers, non-profit organizations and community groups as well as the courts, administrative tribunals and the private bar to address legal problems within our community, including providing community legal education.

Staff Attorney Essential Duties
Provide legal assistance to eligible households at risk of homelessness by preventing evictions, securing mainstream benefits, and making referrals to services that will enhance the household's ability to maintain permanent housing.
Work collaboratively with government and nonprofit agencies that provide supportive services, income, shelter, permanent supportive housing, homelessness prevention and rapid rehousing services, and financial assistance, provide assistance to the homeless and at-risk residents.
Provide legal assistance in maintaining or securing permanent housing and the income necessary to retain permanent housing. Legal assistance will include eviction defense, asserting protections for tenants and fully utilizing the law to preserve tenancies and keep people safe in housing.

Staff Attorney Essential Duties and Responsibilities
Responsible for providing advice, brief service, negotiation, and full representation in foreclosure proceedings, settlement conferences, and other foreclosure-related cases to homeowners at risk of mortgage or tax foreclosure.
Engage in non-litigation advocacy with mortgage servicers, tax districts, and other local and state agencies.

JOB SUMMARY
LASMNY is actively seeking several dynamic full-time Staff Attorneys for our Eviction Defense Program. The employment opportunities are available immediately in the office of your choice, as available. The position reports to the Managing Attorney.
ESSENTIAL JOB FUNCTIONS
Provides direct and comprehensive legal services to eligible clients including advice, negotiation, motion practice, discovery and litigation.
Offers holistic representation to clients with financial and other hardships that could result in loss of housing.
Will appear in the city, town and village courts across our region in eviction and warranty of habitability cases.
Maintain accurate records and statistics for the coordination of timely reports.
Effectively, efficiently and objectively will communicate/interview applicants/clients for services over the phone or in person.
Prepare and file pleadings, motions, briefs and other legal documents.
Independently manage a caseload.
Manage data related to grant reporting process.
Accurately and timely record billable time and case notes in our case management system.
Work professionally and collaboratively with colleagues, judges, opposing counsel, court personnel, community members, bar associations, etc.
Show commitment to professional growth in diverse areas of law.
Keep up with knowledge of legal developments including completion of Continuing Legal Education (CLE) courses.
Engage in outreach and education efforts to reach community members, advocates and service providers.
