Retaining and managing external counsel in accordance with the Company's litigation guidelines;
Recommending/approving loss and expense reserves and financial accruals;
Communicating, in writing, with the General Counsel and applicable management regarding key developments and resolution strategies;
Maintaining oversight of the third-party claims administrator;
Preparing and maintaining departmental reports;
Identifying and ensuring that witnesses and documents are timely sourced for external counsel's use in defending TKE's interests;
Analyzing factual developments from claims and lawsuits to determine if there are post-mortem recommendations applicable to Branch, Area, Region and Corporate operations regarding policies, practices and procedures that reduce financial risk to the organization;
Reviewing invoices from external counsel and other legal department vendors and tracking same against budgets; and
Delivering written and verbal presentations/trainings to Branch, Area, Region and Corporate operations regarding such recommendations.
Who we are looking for
EDUCATION & EXPERIENCE:
A JD from an accredited U.S. law school; be in good standing with and licensed to practice law in at least one state.
Be permitted to practice as an in-house attorney in Florida; and have a minimum of three (3) years of experience either as a litigator or in an in-house legal department managing claims and working with third party claims administrators or insurance carriers.
Proficient in litigation processes and settings (e.g., arbitrations, trials), e-discovery and case management tools and systems.
Knowledgeable about the issues and law that drive general liability and commercial claims.

The General Counsel at Amped Fitness will serve as a trusted advisor to the company, overseeing all legal matters. This role will provide legal guidance to C-suite executives, helping to develop and implement policies and practices that mitigate risks and control costs. The General Counsel will also be responsible for advising on corporate law, industry compliance, litigation, commercial real-estate, cross-functional collaboration with teams to align legal and business goals. You will lead by example, taking ownership of challenges and maintaining high standards of discipline, professionalism, and excellence. Ideal candidates will be highly motivated, with a deep understanding of legal issues impacting the fitness industry and the ability to provide high-quality legal advice.
KEY RESPONSIBILITIES of General Counsel (not limited to):
Provide legal counsel and guidance as an attorney to the business on corporate governance, legal compliance, and risk management across various legal issues.
Represent the company as its attorney in legal proceedings, including court trials and administrative hearings, as necessary.
Draft, review, negotiate, and manage commercial leases and contracts.
Advise on legal risks related to company operations, projects, and contracts, and develop strategies to mitigate these risks.
Ensure compliance with data privacy regulations, consumer protection laws, and industry standards.
Supervise external legal advisors and attorneys, ensuring efficient and effective use of legal resources.
Draft, review, and update company policies and procedures to ensure ongoing compliance with applicable laws and regulations.
Support the development and maintenance of a positive and motivating company culture while ensuring a collaborative and compliant work environment.
Perform additional duties as assigned, including corporate events, and public relations efforts where attorney representation may be required.
QUALIFICATIONS:
Education: Juris Doctor (JD) from an accredited law school and admission to the bar in the relevant jurisdiction - Florida State Bar admission required and/or more states
Experience: 3-8 years of relevant attorney experience, with a focus on corporate law, contract law, commercial real estate LOI's and leases, CAM reconciliation, and regulatory compliance.
