Duties Description The New York State Education Department's (NYSED) Office of Professions (OP) is seeking candidates for an Assistant Counsel position in the Office of Professional Discipline's (OPD's) Upstate Regional Office(s). OP regulates over 50 professions licensed by the New York State Board of Regents. Under the direction of OPD management and a supervising attorney, the incumbent of this position will participate in the development and review of investigations into allegations of professional misconduct. Duties of this position include, but are not limited to, the following:
* Provide legal advice to members of the various State boards for the professions;
* Participate in the professional misconduct legal process, which may include serving as an administrative officer at hearings;
* Represent OP before the Regents Review Committee, which reviews decisions of hearing panels in professional misconduct cases;
* Research and prepare well-written briefs, memoranda of law, specifications of professional misconduct, other legal pleadings, internal memoranda, and correspondence;
* Ensure the effective and timely management of all caseloads;
* Interact courteously and effectively with members of the Board of Regents and the various State professional boards, other SED staff, opposing counsel, witnesses, and members of the public; and
* Undertake various legal, administrative, special projects, management responsibilities throughout the Office of the Professions.
Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have been admitted to the New York State Bar AND have three years of relevant, post-graduate experience, including significant trial work or administrative hearing experience, demonstrating progressively responsible experience in such areas.
Additional Comments CONDITIONS OF EMPLOYMENT: This position is in the exempt class and the incumbent will serve at the discretion of the Commissioner of Education. Salary will be commensurate with education and experience. Promotions and transfers may change appointees' negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of admission to the New York State Bar will be required at the time of interview for all candidates. This position will require frequent same-day travel and occasional overnight State-wide travel. PAY RANGE: $97,500 to $120,000 per year
Coughlin & Gerhart, LLP is seeking a full-time New York State admitted attorney with 3+ years of experience for our Public Law practice group.

RESPONSIBILITIES:
Interpretation and advice on municipal law, education law, SEQR, code enforcement, land use, and zoning.
Representing municipal clients at board meetings, including town, village, city, fire district and school district meetings.
Drafting and reviewing local laws, resolutions, policies and procedures, and contracts.
Defending municipal clients in litigation and claims, including research and drafting legal documents in Article 78 proceedings.
Negotiate/draft/review of contracts, leases, bid documents, easements, indemnification agreements, inter local agreements, and other documents.
Prosecuting code enforcement cases, including building code, zoning code and dangerous dog cases.

Requirements
QUALIFICATIONS:
Current New York Bar admission.
Juris Doctor degree from an accredited law school.
3+ years of experience in Public Law preferred.
Desire to develop and further legal skills.

DISTINGUISHING FEATURES OF THE CLASS:
The work involves responsibility for performing legal research and other law related tasks with a limited degree of professional judgment. Inasmuch as employees in the class are not a member of the Bar, their assignments and activities are typically less complex than those ordinarily executed by attorneys. Employees in the class typically exercise no supervision.
TYPICAL WORK ACTIVITIES
Provides legal research and information upon matters pending in the Department of Law;
Prepares affidavits, briefs and other legal documents as needed;
Assists in all legal matters such as hearings, trials, suits, injunctions etc., as may be required;
Performs legal tasks assigned by an attorney‑at‑law;
Studies legal texts;
Assists legal counsel in all matters.
FULL PERFORMANCE KNOWLEDGES. SKILLS. ABILITIES AND PERSONAL CHARACTERISTICS
Working knowledge of legal principles;
Ability to perform legal research;
Ability to express oneself clearly and concisely both orally and in writing;

LOCATION: Staff Relations - Office of Human Resources at Central Offices
WORKING HOURS: This position will work a minimum of 20 hours per week. This position is part-time.
SALARY/COMPENSATION: The pay rate for this position is $15.50 per hour.
QUALIFICATIONS:
