POSITION SUMMARY Corporate litigation attorney will be acting as counsel of record, representing various healthcare facilities under our management. Must be confident and comfortable handling full case responsibility from intake, pleadings, discovery, motion practice, up to trial preparations. This is an in-house position, and may include some corporate/transactional work, but will focus primarily on our litigation needs. Must have a working knowledge of employment laws, and experience with these cases. Duties Help OPLA is the largest legal program in the Department of Homeland Security (DHS), employing over 1,700 attorneys nationwide. In addition to Headquarters in Washington, D.C., there are 24 OPLA Field Locations in more than 60 cities throughout the United States. Pursuant to statute, OPLA serves as the exclusive representative of DHS in removal proceedings before the Executive Office for Immigration Review litigating cases involving criminal aliens, terrorists, human rights violators, and other priority aliens. OPLA also provides a full range of legal services to all ICE programs and offices. OPLA attorneys provide legal advice and prudential counsel to ICE personnel on their law enforcement authorities, legal liability under the Federal Tort Claims Act and Bivens v. Six Unknown Named Agents of Fed. Bureau of Narcotics, 403 U.S. 388 (1971), the Freedom of Information Act and Privacy Act, ethics, and a range of administrative law issues, such as contract, fiscal and employment law. OPLA attorneys represent the agency before the Merit Systems Protection Board, the Equal Employment Opportunity Commission, and the Contract Board of Appeals. OPLA attorneys support the Department of Justice in the prosecution of ICE cases and in the defense of civil cases against ICE. The selected attorney will immediately be given significant responsibilities and will be expected to craft legally supportable policies to address the needs of agency operational components. The attorney will be expected to routinely provide timely legal opinions to ICE officers and agents, management, and leadership within OPLA, ICE, and DHS's Office of the General Counsel Headquarters. The selected attorney will be required to assess litigation risk and provide litigation support to the Department of Justice. Position: Staff Attorney Experience: 6+ months Application Deadline: Open until filled Location: CRLA HQ, Modesto - Hybrid Other: FLSA Exempt, Full-Time, Union Position The Unincorporated Justice Program utilizes a community lawyering model to address environmental justice issues in rural communities. The model calls for creative, innovative advocacy that uses a multipronged approach to address the issues and their systemic roots. Approaches such as community leadership development and policy advocacy are as important to the work as traditional legal advocacy. The Staff Attorney should be creative and willing to partner with community residents to address the issues and their underlying causes. The program covers a wide array of legal areas ranging from access to services such as water and broadband to the inequitable distribution of resources and siting of hazardous land uses. The program's client communities are Disadvantaged Unincorporated Communities (DUCs) that suffer the consequences of historic underinvestment and discriminatory policies. They bear the burden of unjust and inequitable conditions and decisions. The Staff Attorney will work with the Managing Attorney and staff to develop and implement creative advocacy strategies to address community-identified environmental justice issues in the Central Valley. Primary responsibilities include legal advocacy/litigation support, factual research, community outreach and education, community leadership development, and analysis of pending policies. Essential Responsibilities/Duties: Provides legal services to low-income clients and client groups, including advice, negotiation, litigation, and administrative advocacy in accordance with program priorities and case-handling policies. Reviews and supervises the work product of Community Workers and Clerical support staff relating to all clients being advised or represented by him/her. Undertakes significant statewide impact activity, including institutional and group litigation or community economic development beneficial to the low-income community. Works to develop specialized knowledge in a substantive area of poverty law and acts as a resource for other staff through participation in at least one CRLA task force.
