Position Summary
The Assistant Commonwealth Attorney III represents the Commonwealth of Virginia when there have been violations of criminal law. The ACA III will be assigned the prosecution of traffic, misdemeanor and felony criminal cases across Fairfax County's three courts (General District Court, Juvenile and Domestic Relations Court, and Circuit Court).
Common case assignments include larceny, DUI, assault, and drug possession. The ACA III will be in trial court on most days. Duties include preparing arguments for court; conducting legal research; writing motions; and consulting with officers, victims, and witnesses in advance. Paralegals and administrative staff assist in the preparation of dockets.

Provides legal services, advice, and representation to the Department of Human Services (DHS); advises DHS staff on legal aspects of casework and assists staff in preparing for litigation. At-will employee; serves at the will and pleasure of the County Attorney. This position is part of the County Attorney - Human Services career progression series, which includes Staff Attorney - Human Services, Assistant County Attorney - Human Services, and Senior County Attorney - Human Services. * Presents cases before all relevant courts and administrative bodies.
* Organizes trial and hearing preparation; drafts and files legal documents and prepares questions and arguments necessary for hearings or trials; notifies and interviews witnesses; reviews evidence.
* Prepares memoranda of law and opinion letters as needed and directed by the Chief Deputy County Attorney.
* Researches and interprets the Colorado Children's Code, Probate Code, Social Services Code, and the Colorado Code of Regulations pertaining to same.
* Researches other State and Federal statutory and common law, regulations, policies, agency letters, legal treatises, articles, manuals, and writing in the field as needed to prepare all cases or legal issues for hearings, trials, or other resolutions.
* Interprets and applies Colorado Rules of Civil, Juvenile, Probate, and Appellate Procedure.
* Meets with counsel representing parents, children, at-risk adults, and other parties to identify litigated issues, resolving them through mediation, negotiation, stipulation, and/or trial.
* Provides training to DHS staff regarding legal aspects of case preparation, trial/hearing preparation, testimony, and related legal processes as needed.
* Provides other legal services as requested by the Chief Deputy County Attorney and/or County Attorney.

* Attends meetings with DHS staff to coordinate legal services and policies with client.
* Participates in rotation of 24-hour on-call consultation service to El Paso County DHS Intake.

* Utilizes State court and State agency computer systems. Conducts computer-based legal research.

The Intake and Prison Legal Services department is seeking a motivated current 2L or 3L student with a legal intern certificate who has demonstrated a commitment to public defense work and social justice and who is interested in working with people who are currently incarcerated. Your job duties would include reviewing discovery material for parole and post-release control violation hearings, contacting relevant witnesses and gathering relevant evidence, observing panel or full board hearings for clients seeking release after decades in prison, conducting legal research for violation hearing defenses and in response letters or calls from incarcerated people and their loved ones. Under the supervision of a licensed attorney represent clients at post-release control hearings, conduct client interviews, engage in factual investigations, and review case material and analyze pending cases. Participate in department meetings, moot courts, roundtables, and agency-wide meetings.

When needed and requested, assistance with representation of the Department of Social Services in Family Court related to Child and Spousal Support, Child Abuse and Neglect, Custody and Visitation, Termination of Parental Rights, and Permanency Hearings for children in foster care.
Examination and rendering of legal advice, opinions, and analysis to the Board of Legislators or to any County Department in the absence of the County Attorney or when so directed by the County Attorney.
Performance of a variety of legal research.

Job Responsibilities:

Interns will observe and assist with witness interviews, hearings, and trials; listen to and transcribe 911 calls; and review police reports. They will also participate in the decision-making process regarding offers and assist with plea negotiations. Interns will engage in a rigorous and dynamic training program that includes lectures led by members of the criminal justice community and participation in several simulated practicums throughout the summer. Every effort will be made to provide each intern with a substantive writing assignment that may be used as a future writing sample in job searches.In addition, interns will benefit from robust networking opportunities designed to support their professional development and career growth. These opportunities may include small-group conversations with Assistant District Attorneys, panels featuring senior leadership, exposure to specialized units across the Office, and meet-and-greets with members of the broader criminal justice community. These engagements allow interns to build meaningful connections, explore potential career paths, and gain deeper insight into the work of a large urban prosecutor's office.
