The Texas Public Policy Foundation's Center for the American Future is seeking to hire an attorney-who may work fully remote or at our Austin, Texas, headquarters-with at least five (5) years of litigation experience to join our growing team as we litigate against government overreach. The idea candidate will be ready to hit the ground running and excited about defending individual liberty, enforcing constitutional limits on the government, and promoting a vision of America where individuals are free to flourish. He or she will immediately become an important part of a close-knit legal team of approximately eight (8) attorneys, as well as the larger TPPF organization.

The Role:Description:
The Texas Public Policy Foundation is seeking an aggressive and innovative litigator with experience in the federal judiciary as an Attorney for the Center for the American Future. The qualified applicant will possess a strong love of liberty as the foundational purpose of government, an enthusiasm for Texas as the keystone of the American Dream, and an eagerness to challenge precedent and convention within the legal sphere in the defense of both.
The Center for the American Future defends the Constitution through legal opposition to government overreach. The Center launches legal challenges at the administrative, district, and appellate court levels on behalf of ordinary people whose lives, liberty, and property are threatened by government action in defiance of the Constitution.
This position can work in our Austin, Texas headquarters, or fully remote with the understanding that a moderate amount of travel will be required.
Responsibilities include, but are not limited to:
This candidate will report to the Center's Director and be called upon to execute the Foundation's legal work plan as part of a two-person team that is managed by one of our Senior Attorneys. This includes building a robust docket and advancing the Foundation's strategic priorities. The Attorney will be an active participant in complex litigation, including the discovery process, briefs, trials, appellate work, and amicus briefing.
Qualifications:
The Attorney for the Center for the American Future must be a “happy warrior” with a keen drive to blaze new pathways in the fight to reclaim territory from Washington, D.C. He or she must have the following qualities:
A self-starter. The Attorney must be willing and able to conceive and develop innovative ideas independently and often -- and bring them to fruition.
A polished legal writer. This Attorney must possess the aptitude for graceful prose that conveys complicated concepts convincingly.
A strategic thinker. Specifically, the Attorney must be a strategic legal thinker, with a Juris Doctorate, able to grasp Constitutional law sufficient for handling complex litigation matters and authoring amicus briefs that advance the strategic vision of the Foundation.
An advocate. The Attorney must bring to a table litigation experience in trial and appellate courts, administrative law, policymaking, legislation, and/or media -- and a proven record of accomplishment.
A leader. The Attorney must be willing to work with tact and persuasion to assist in assembling a coalition of activists, thinkers, and citizens in several states to challenge Washington, D.C., overreach on several fronts.
Optimistic and good-humored. The Center for the American Future highly values its “happy warrior” ethos. This work is not for the faint of heart. An optimistic, positive approach to challenges-as well as the ability to take one's work seriously without taking oneself too seriously-is critical.

The attorney will work on a team of civil attorneys and paralegals that handles cases including civil protective order defense, adult and juvenile record-sealing, asset forfeiture cases, administrative license revocations, mitigation investigations, parole revocation, and other miscellaneous civil legal issues.
The PDO represents indigent clients who have been accused of misdemeanor and felony offenses in Harris County, and the Holistic Services Division aims to address collateral consequences and existing legal and non-legal issues in our clients' lives that drive them into the criminal justice system. We provide dignity and personalized attention to our clients in hopes of stabilizing their lives and reducing their chances of returning to the system.

In this position, you will become a key member of the legal team of the Office of Chief Counsel. Typical work assignments include:
* Providing legal guidance to, and advocating on behalf of, U.S. Customs and Border Protection (CBP) in a wide variety of matters, including real property issues, such as providing detailed title review for CBP-funded land acquisitions including problematic conveyancing issues and the optimal resolution of such issues.

Career Progression: As a General Attorney, the full performance level is GS-14. General Attorneys are eligible for promotion to the next GS level after serving a minimum of one year at their current GS level, and at a minimum, have a "Meets Expectations" performance rating. Once a General Attorney reaches the full performance level of GS-14 and meets time in grade and performance standards, they may compete for a GS-15 position, such as senior attorney or a supervisory attorney position.

OPLA is the largest legal program in the Department of Homeland Security (DHS), employing over 1,700 attorneys nationwide. In addition to Headquarters in Washington, D.C., there are 24 OPLA Field Locations in more than 60 cities throughout the United States. Pursuant to statute, OPLA serves as the exclusive representative of DHS in removal proceedings before the Executive Office for Immigration Review litigating cases involving criminal aliens, terrorists, human rights violators, and other priority aliens. OPLA also provides a full range of legal services to all ICE programs and offices.
OPLA attorneys provide legal advice and prudential counsel to ICE personnel on their law enforcement authorities, legal liability under the Federal Tort Claims Act and Bivens v. Six Unknown Named Agents of Fed. Bureau of Narcotics, 403 U.S. 388 (1971), the Freedom of Information Act and Privacy Act, ethics, and a range of administrative law issues, such as contract, fiscal and employment law. OPLA attorneys represent the agency before the Merit Systems Protection Board, the Equal Employment Opportunity Commission, and the Contract Board of Appeals. OPLA attorneys support the Department of Justice in the prosecution of ICE cases and in the defense of civil cases against ICE.
The selected attorney will immediately be given significant responsibilities and will be expected to craft legally supportable policies to address the needs of agency operational components. The attorney will be expected to routinely provide timely legal opinions to ICE officers and agents, management, and leadership within OPLA, ICE, and DHS's Office of the General Counsel Headquarters. The selected attorney will be required to assess litigation risk and provide litigation support to the Department of Justice.
As a General Attorney, you will perform the following duties at the full performance level:

* Prepare witnesses for litigation; conduct direct examination and cross examination; present oral arguments advancing ICE's legal position; negotiate the disposition of cases with opposing counsel; and advise the Chief Counsel and/or Deputy Chief Counsel on cases potentially warranting deferred action or other exercise of prosecutorial discretion;
* Construct litigation reports for United States Attorney's Offices on civil matters pending in the federal courts involving ICE, and serve as liaison between Department of Justice's Office of Immigration Litigation and the local Enforcement and Removal Field Office on immigration matters pending in the Circuit Courts of Appeals;
* Provide legal advice and support to the other ICE components and litigation support to United States Attorney's Offices in immigration and/or customs matters. This is a 10 week paid summer law clerk position for those who will have completed some of their course work from an ABA-accredited law school and thus considered a strong 1L, or 2L or recent graduate by the beginning of Summer 2026. This position is supervised by the Deputy City Attorney for the nine-person, in-house legal counsel for the City of College Station, population approximately 120,000. The clerk will have opportunity to work with various attorneys and paralegals in the office depending on the project or work assignment. This is an opportunity to gain insight into public law and what it's like to be in-house legal counsel for a public entity.
The City Attorney will sponsor the hired applicant for their State Bar of Texas Supervised Practice Card.
General Municipal Law Practice. This includes real estate, contracts, employment and other general law areas. The law clerk may assist in title review, preparation of deeds and related real estate documents, organization of documents for various transactions, proofreading of contracts, and researching legal issues related to these matters.
Prosecution. The law clerk may assist the City Attorney's Office in municipal court prosecution of Class C misdemeanors. Work may include preparation and review of complaints, assisting in processing plea bargains and similar matters, and conducting legal research. Criminal cases prosecuted include traffic laws, City ordinance violations, DOC noise complaints, dangerous dogs, and class C assaults.
Public Information. The law clerk may assist in compliance with the Texas Public Information Act, including reviewing documents, redacting information, revising or preparing form responses, and researching matters related to the requests.
