Job Description FDA Compliance: Counsel on food labeling, packaging, ingredient disclosures, nutrition facts/claims, and product development. Marketing & Advertising: * Review product claims, promotional campaigns, and digital and influencer marketing to ensure compliance with FDA, FTC, and privacy standards. * Counsel on substantiation of health, nutrition, and sustainability and environmental claims. Consumer Protection: Advise on state and federal statutes including: * Junk fee and price transparency laws; * Automatic renewal/negative option laws; * Telephone Consumer Protection Act (TCPA); and * CAN-SPAM Act and related marketing laws. Privacy & Data Protection: * Provide practical guidance on consumer data privacy and security practices, including compliance with privacy laws (e.g., CCPA/CPRA, HIPAA, COPPA, and various U.S. state privacy laws). * Review marketing, e-commerce, and digital advertising strategies for compliance with privacy and data-use regulations. * Develop privacy policies, notices, and internal data-handling practices. Agency Engagement: Draft responses to inquiries from the FDA, FTC, state attorneys general, and other regulators. Monitoring & Strategy: Track and analyze regulatory, enforcement, and legislative trends across FDA, FTC, privacy, and state AGs; advise leadership on impact, emerging trends, and strategic mitigation. Compliance Programs: Design and deliver policies, training, and SOPs to strengthen compliance culture across FDA, consumer protection, and privacy areas. Qualifications * 3-6 years of legal experience in FDA compliance, consumer protection, and/or privacy law (law firm, government, or in-house). * J.D. from a top tier school with active bar membership in good standing. California bar membership not required. * Big law and/or in-house counsel experience in food, beverage, or consumer packaged goods. * Background in digital marketing, subscription/renewal programs, and consumer data use. * Familiarity with global privacy frameworks (GDPR, Canada's PIPEDA, etc.). * Excellent communicator with ability to deliver business-minded and risk-balanced advice. * Team player with strong collaboration skills across R&D, marketing, compliance, and operations. * Confident presence with resilience to navigate ambiguity, pushback, and high-stakes decisions. * Adaptability and comfort working in a fast-paced, evolving environment. * Growth mindset with eagerness to learn new areas of law and regulation. Pay Range: $230,000 - $250,000 and may include a discretionary bonus. Final compensation will be dependent upon skills & experience.
