Position Summary: This Senior Assistant Attorney position is in the Office of the Attorney Gerenal within the Antitrust Enforcement Unit in Tallahassee, Florida.

Qualifications:
Admission to the Florida Bar and six (6) years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. The Antitrust Division is seeking a motivated attorney to join a collaborative and dynamic legal team that investigates and enforces cases under state and federal antitrust laws, Florida False Claims Act, Florida securities law, Civil Racketeering and as needed civil complex enforcement of the Florida Consumer Protection Act. The Division's caseload includes cutting-edge and high-profile matters that receive national attention. The Division collaborates with the U.S. Department of Justice, the Federal Trade Commission, other state attorneys general and Florida agencies. This position is located in Tallahassee, Florida. * INVESTIGATION OF ANTITRUST VIOLATIONS
The candidate will plan, organize and direct a team approach to industry-wide investigations, with an emphasis on those involving purchases by the State and/or local governments, by combining the skills of attorneys, economists, data processing professionals, investigators, and supporting paraprofessional and clerical personnel to gather, analyze and interpret the antitrust significance of observed marketplace behavior as revealed by all available relevant data.
Analyze and evaluate business practices in order to make initial determination of whether violations of state or federal antitrust laws may have occurred.
Interview fact witnesses and/or direct an investigator in conducting such interviews.
Obtain evidence in the form of sworn testimony, answers to written interrogatories and/or documents by means of antitrust Civil Investigative Demands (CIDs).
Obtain proffers of testimony from prospective witnesses.
Prepare pleadings and legal memoranda and present oral argument on issues involved in legal challenges to compulsory investigative demands.
Coordinate investigative efforts with other interested law enforcement agencies, including local state attorneys, attorneys general of other states, the Antitrust Division of the United States Department of Justice and the Federal Trade Commission.
Report to the Antitrust Division Director regarding the results of investigations and makes recommendations regarding enforcement options.
* LITIGATION OF ANTITRUST CASES
Prepare initial and responsive pleadings, motions and memoranda of law in antitrust cases filed in both the state and federal trial courts.
Plan and conduct, with the assistance of subordinate attorneys, all phases of taking and defending discovery, including negotiations with opposing counsel, inspections and copying of documents, interrogatories, depositions, stipulations, etc.
Develop and implement litigation strategy and supervise all aspects of trial preparation as the senior member of a trial preparation team.
Select and supervise the work of expert witnesses in the fields of economics and statistics in preparing expert testimony as to liability and/or damages.
Prepare briefs and present oral argument before all levels of state and federal courts.
Plan and supervise the presentation of evidence at trial.
Take primary responsibility for settlement negotiations and the form and content of settlement agreements and related documents.
Establish guidelines and policies for verifying, allocating and distributing claims against damage recoveries in parens patriae and governmental monopoly claim class actions.
Report to the Antitrust Division Director on the progress of litigation, including recommendations to make, accept or reject settlement offers.

Recognize the need for legislative changes in the state antitrust laws or closely related statutes and supervise the drafting of proposed legislation.
Assess the impact of proposed legislation on antitrust enforcement efforts and competition policy generally.
Respond to antitrust-related inquiries from private citizens, officials and agencies of state and local governments and other members of the Attorney General's staff.
Represent the Antitrust Division at educational and professional meetings where issues of significance for antitrust enforcement are discussed.

The Office of the Capital Collateral Regional Counsel - Middle Region ("CCRC-M") has an opening for a full-time capital post-conviction attorney position in Tampa, Florida. CCRC-M advocates for indigent persons sentenced to death in the State of Florida in their state and federal post-conviction proceedings.
Job Duties: CCRC-M attorneys must be able to develop rapport with death-sentenced clients, to investigate, draft, and present motions for post-conviction relief in state court, and to litigate access to public records. CCRC-M attorneys will also conduct evidentiary hearings in state circuit court, and file and argue appeals in the Florida Supreme Court. It may also require occasionally working beyond business hours, which may include nights, weekends, and holidays. A background investigation is required as a condition of employment.
Selection Criteria: Candidates must possess a commitment to the defense of death-sentenced individuals; have excellent writing and oral advocacy skills, and an ability to think creatively and strategically about capital litigation. Duties and Responsibilities
This position serves as a Troop Legal Advisor to a Troop within the Florida Highway Patrol and Assistant General Counsel to the Department of Highway Safety and Motor Vehicles. This position provides legal advice and training to FHP members. The Public Defender's Office has protected the Constitution and the rights of Florida citizens since the landmark Supreme Court case, Gideon v. Wainwright. Our office is responsible for providing legal counsel, when appointed by the Court, to those accused of criminal offenses who cannot afford to hire a lawyer, performing as trial counsel by representing defendants during courtroom proceedings, researching case law, communicating with defendant to determine trial strategy such as cross-examination procedures, witness selection, jury selection, testimony decisions and opening and closing arguments.
