A Criminal Investigator is responsible for performing comprehensive investigative work to support prosecution activities of the District Attorney's Office. The following are duties assigned to the Criminal Investigator: Working closely with prosecutors in preparing criminal cases for trials, related hearings and testifying in court. Investigating alleged or suspected criminal violations of State laws to determine if there is sufficient evidence to recommend prosecution. Responsible for locating, contacting, and preparing state witnesses for trials, assisting various law enforcement personnel by providing investigative assistance and technical investigative support, assisting with training new investigators, making arrests and filing criminal cases. Other duties and responsibilities as assigned. Job Duties: Essential Duties and Responsibilities include but are not limited to: ● Conduct all initial intake screenings and complaint processing as directed by the Investigations Manager. ● Conduct retaliation investigations to include conducting interviews, locate, analyze, collect evidence, and documents as necessary to support and determine case outcomes. ● Prepare, send, and track correspondence with various parties including Respondent. ● Answering and following through on questions generated by external and internal customers related to retaliation investigations, safety inspections, complaints, OSHA standards, laws, rules, and codes. ● Assist the Investigations Manager and/or in their absence with training and directing staff to interview witnesses, and other persons to collect evidence and information pertaining to retaliation case development, prima facie analysis and determining potential violations. ● Assist staff to efficiently gather investigative information and oversee correspondence with various parties. ● Assists in helping review investigation case files, identify and investigate course actions to ensure investigation are quality and timely as required. ● Discuss with staff case issues, analysis techniques and provide direction as necessary to assist the Investigations Manager and/or in their absence. ● Conduct legal research to identify laws, rules and legal procedures applicable to particular issues and case development, confer with staff for feedback on investigation activity. ● Meet with staff to coordinate investigation activity. ● Attempt to facilitate a fair settlement between parties when possible and in support of ADOSH mission Knowledge, Skills & Abilities (KSAs): Knowledge of ● Federal Whistlblower laws and procedures, Arizona Labor Department's statutes and rules relating to Retaliation complaints A.R.S 23-425 statutes ● Investigative and analytical techniques ● ADOSH Whistleblower Investigations Manual ● The Industrial Commission of Arizona Policies and Procedures ● OSHA Applications for Whisleblower ● OSHA Information System (OIS) ● Occupational safety and health recognition (e.g. unsafe trenching practices, fall hazards, electrical hazards, machine guarding, respiratory hazards, chemical exposures) and their potentials for causing injury and/or illnesses ● Effective methods for eliminating or controlling occupational safety and health standards ● Google Suite, Windows, Excel and Word Skills in ● Oral and written communication ● Organization ● Typing and using a keyboard ● Time management ● Interpretation of laws, standards, rules and operating procedures ● Advocacy ● Application of cost effective and appropriate corrective measures to control workplace safety hazards ● Interpersonal retaliations ● Recognition and evaluation of occupational safety and health hazards ● Investigative procedures, report writing, and documentation of case files. Ability to ● Manage reports to meet deadlines. ● Manage heavy workloads with high level of accuracy and production ● Review and interpret employer's safety and health management system ● Work well under pressure ● Recognize hazardous conditions in workplaces within the construction, general, and agricultural industries ● Recognize and engage tactfully those with different backgrounds, characteristics and perspectives ● Analyze business policies, employee agreements and wage payment policies that apply to commissions, bonuses, overtime and vacation leave ● Gather and analyze information through various sources from interviews, witnesses, and documentation and other evidence Selective Preference(s): The ideal candidate for this position will have: BS in related Safety and/or Health field. Six years experience conducting complex regulatory, law enforcement or private investigations and/or three years experience in conducting, assisting, or supervising OSHA Retaliation investigations. Course/training in advanced investigation techniques and procedures including A.R.S. 23-425, EEOC, OSHA. Ability to communicate in Spanish. Pre-Employment Requirements: Any employee operating a motor vehicle on State business must possess and retain a current, valid class-appropriate Arizona driver's license, complete all required training, and successfully pass all necessary driver's license record checks. The license must be current, unexpired, and neither revoked nor suspended. Employees who drive on state business are subject to driver's license record checks, must maintain acceptable driving records, and must complete all required driver training. An employee who operates a personally owned vehicle on state business shall maintain the statutorily required liability insurance (see Arizona Administrative Code (A.A.C.) R2-10-207.11).
