General Description
Represents the Texas Commission for Lawyer Discipline in attorney disciplinary proceedings before District Grievance Committees, District Courts, and the Board of Disciplinary Appeals. Involves frequent contact with State Bar departments, as well as with outside agencies and organizations, and participants in the attorney discipline system.
Primary Functions
1. Represents the Commission for Lawyer Discipline in attorney discipline litigation, including hearings before evidentiary panels of the grievance committee, district court trials and proceedings before the Board of Disciplinary Appeals.
2. Negotiates and evaluates settlement offers on behalf of the Commission for Lawyer Discipline in attorney discipline matters.
3. Represents the State Bar of Texas where appropriate in civil actions in state and federal courts.
4. Drafts documents for proceedings before a grievance committee or district court, including investigative reports, disciplinary petitions, discovery requests and judgments and orders.
5. Performs pre-litigation investigations related to the processing of grievances.
6. Attends and presents cases at Summary Disposition dockets and Investigatory Hearings before grievance committee panels.
7. Acts as liaison with Special Counsel as assigned.
8. Mentors less experienced lawyers in the office.
9. Provides ethical direction to State Bar members.
10. Performs other responsibilities as required.
Position Requirements
Applicants must be licensed to practice law in Texas and be in good standing with the State Bar of Texas. A minimum of five years litigation experience is preferred. The position requires knowledge of litigation and appellate practice (state and federal), including the Rules of Civil Procedure and Rules of Evidence, and familiarity with the Texas Disciplinary Rules of Professional Conduct and Texas Rules of Disciplinary Procedure. Effective legal research and writing skills. Position also requires technological competency, including experience using Microsoft Word, Adobe, Zoom, Microsoft Teams, Microsoft Outlook, etc. Applicants must be able to communicate effectively, coordinate workflow to meet mandatory deadlines, manage a large caseload and maintain a professional demeanor and appearance. 6. Gathers, prepares, and presents evidence, exhibits, and related material for trial or hearing.
7. Represents the State and client in trial and hearings by:
conducting jury selection,
presenting opening statements,
conducting direct and cross-examinations of witnesses, and
presenting closing arguments.
8. Participates in settlement or plea-bargain negotiations.
9. Prepares necessary legal document if settlement or plea-bargain agreement is reached and ensures signatures are secured and documents filed as required.
10. Performs other duties as assigned.Education, Experience and Training:
Graduation from an accredited law school. Six (6) months of experience practicing law.
Special Requirements/Knowledge, Skills & Abilities:
Requires a current license to practice law in the State of Texas. Requires experience prosecuting all levels of misdemeanor offenses, including jury selection.
