How many hours can a 16-year-old work in a week?

By Justin Parker - Feb. 20, 2023

A 16-year-old can work up to 40 to 48 hours in a week in most states when school is not in session. When school is in session these minors have the ability to work:

  • 3 hours per school day

  • 8 hours per non-school day

  • 40 hours per school week

  • 48 total per non-school week

  • No more than 6 consecutive workdays ( six work days in a row)

  • Until 10 pm on nights followed by a school day

These minors are not allowed to have work start times between 12 am and 6 am. With written parental permission, 16-year-old minors may work until 11:00 pm on nights followed by a school day. There may or may not be restricted end times on nights not followed by a school day, this depends on each state's own individual child labor laws.

In many states, 16-year-old minors may not work in an establishment open to the public between 10 pm and 6 am, unless another employee at least 18 years of age also works during the same hours as the minor.

Child labor laws can vary state by state, however, most follow these guidelines on hours with little or no variation.
