A 17-year-old can work no more than 18 hours weekly in New York when school is in session. When school is not in session, a 17-year-old in New York can work no more than 48 hours. The hours that a minor can work in New York depend on the following:
The age of the minor
The type of work the minor is doing
Whether the minor is attending school or not
New York State has some of the most strict child labor laws in the United States. The law limits the number of hours that minors under 18 may work when school is in session. Minors of all ages, including 17-year-olds, can not work during school hours when school is in session.
17-year-olds need written permission from a parent or guardian and a certificate of satisfactory academic standing from their high school to work between 10 PM and 12 AM on a day before school.
17-year-olds enrolled in an approved Cooperative Education Program (CEP) may work up to 6 hours the day before a school day, as long as the hours are part of the program. Include any hours worked in such a program when determining hours worked for the 4-hour limit.
When their high school is not in session (during holidays, breaks, and other school closures):
Minors under 18 may not work more than 8 hours a day and can not work more than six days per week
Minors 14 and 15 may not work more than 40 hours a week
16 and 17-year-olds may not work more than 48 hours a week
