Can an employer record audio at the workplace?
No, an employer cannot record audio at the workplace. The only way an employer can legally record audio at a workplace is with the consent of all parties that might be recorded.
The Electronic Communications Privacy Act (ECPA) makes it legal for employers to listen in on calls concerning business, but they are not allowed to record or listen in on private conversations.
Employers are allowed to install audio recording equipment in workplaces if it applies to the business or organization's services, although this can only be done in "work" locations and not locations where employees take breaks, such as break rooms, cafeterias, restrooms, or locker rooms.
While an employer can use audio recording equipment in a work environment where this service is related, they cannot listen to private conversations or record audio without the consent of any affected parties.
