How much does jury duty pay?

By Zippia Team - Feb. 1, 2023

Jury duty pay, and the laws surrounding it, vary state by state and business to business. Federal law does not require employers to provide leave for their employees for jury duty. It also does not require specific pay. However, some states and areas have prohibited employers from making their employees use paid time off for jury duty.

While some states do have set laws for pay during jury duty, most do not. Many companies do offer paid time off for jury duty, and for those that do offer this, the pay is the same as any other day. There may be instances where someone has to go to jury duty and is unpaid by their job.

Federal jury duty does pay through the government. This pay rate is $40 per day. This would be on top of any earnings from your employer. Typically, states pay less than the federal rate, but they pay some money to each juror.

If someone cannot be a juror due to the financial necessity of not missing work, they can apply for an exemption, but that is still up to the court's discretion.
