Work You'll Do The GPS State, Local & Higher Education (SLHE) Risk Manager/Senior Negotiator will be responsible for supporting Deloitte Consulting's GPS practice from a contracting and negotiation perspective, covering the full life cycle of an engagement. The role provides the organization with a focal point for business risk and contract negotiations, from analysis to mitigation recommendations to leadership. Additional responsibilities are as follows: Deal Desk Support, Contracting and Negotiations * Assist with deal desk and contract review activities and support our sales team with deal and contract structuring, RFI/RFP/Proposals, and contract review, drafting custom provisions and negotiations * Intersect with various functions including sales, legal, finance and delivery to act as a strategic advisor to help manage deal flow and to optimize sales and contracting cycles * Work closely with deal teams and legal in reviewing and negotiating agreements, such as master agreements, confidentiality agreements and teaming agreements * Own risk consultation and contracting review of scope of work/SOW documents * Provide guidance on contracting and negotiation strategies and ensure cross-functional alignment through contracting life-cycles * Ensure contracting requirements are met and handled in a manner that is consistent with the Firm's policies, requirements, and good business practices Ongoing and Post Execution Risk Management and Contracting Support * Assist with ongoing contracting, risk management and mitigation support for ongoing contracting requirements - SOWs, Change Orders, amendments, and renewals * Facilitate continued compliance with contractually required policies and processes and with the Firm's internal policies * Continue to collaborate with different functions to socialize agreement/contractual requirements and business terms * Work actively with account leadership and quality team to identify and help mitigate post-signature delivery and engagement risks Knowledge Management and Training Support * Maintain knowledge of core professional services (IT, Managed Services, Outsourcing) and product offerings to continue supporting contracting and risk matters in a fast paced constantly changing environment * Work independently to manage contractual matters and risks and be the trusted advisor on multiple accounts * Provide mentoring and training to Risk Management colleagues and to a broader audience to enhance knowledge of and compliance with firm's policies, templates and processes * Proactively pursue, assess and, where appropriate, advance firm's initiatives including in the areas of software, cloud, data analytics, operate services and privacy & security * Support strategic initiatives pertaining to development/updating of processes, tools, and templates to improve overall risk management and contracting practices and to help drive adoption of such processes, tools, and templates Qualifications: Required: * 10+ years of direct contract negotiation for technology services (i.e., technology delivery and implementation services) * Experience with managing the negotiation, delivery, and risk assessments of large professional services and product contracts * Experience in working with client delivery teams; preferably in State, Local, or Higher Education * Experience with complex contract negotiation and working high stakes multi-million-dollar engagements * Knowledge of professional services contracting lifecycle with an emphasis on technology services * Bachelor's Degree * Ability to travel up to 10-25%, on average, based on the work that you do and the clients and industries/sectors you serve * Must be legally authorized to work in the United States without need for employer sponsorship, now or at any time in the future Preferred: * Juris Doctor (JD) Degree preferred The wage range for this role takes into account the wide range of factors that are considered in making compensation decisions including but not limited to skill sets; experience and training; licensure and certifications; and other business and organizational needs. Manages Risk Management activities and issues throughout the City. SUPERVISION EXERCISED May exercise technical and functional supervision over administrative support staff. ESSENTIAL DUTIES * Prepare, recommend, and administer the Division of Risk Management budget and monitor fiscal matters to assure conformance with budget constraints and risk program initiatives. * Prepare and administer a risk management plan by developing standards and assessing and evaluating various risk mitigation techniques and assisting with implementation among City departments. * Conduct technical research analysis and prepare detailed reports and recommendations on issues concerning the functions and operations of risk programs. Assess potential risk impacts and make recommendations regarding interpretation and compliance options to City departments. * Consult with department heads and City officials to identify and remedy at-risk facilities, work processes, conditions and/or situations, providing technical advice, and coordinating training programs as needed. * Coordinate with a commercial broker and insurance carriers to develop, implement, and monitor cost-effective insurance programs to cover City-owned property, general liability, liability of vehicles and employees when warranted. Monitor commercial insurance coverage levels and endorsements as exposures change and new products become available. * Work with actuaries to understand and recommend appropriate levels of funding for City liabilities and risk management programs. * Develop and implement City-wide risk management policies and risk avoidance programs. Respond to inquiries on program policy and procedural matters as appropriate. Review and evaluate existing and pending safety rules and regulations. Identify, conduct, document, and/or arrange needed safety and liability training, and recommend incentive and recognition programs as part of the safety program. * Develop and maintain tracking and retrieval system for monitoring claims and potential claims filed against the City. Use system and data to understand City risks and assist City officials and employees in effectively managing risk. * Administer liability claims; conduct investigation of liability claims, including responding to incident scenes, preserving evidence, taking photos and/or video, taking statements, locating witnesses, and obtaining cost and repair estimates; manage claims processing, including validity and liability assessment, recommending legal dispositions, and documenting caseload. Assist the City's insurance carrier and departments in gathering claims information, evaluating claims, minimizing City impacts and recommending corrective action is taken where necessary. Conduct technical research analysis and prepare detailed reports and recommendations on issues concerning the functions and operations of risk programs. Identifies and quantifies areas of risk; develops, implements, and coordinates risk reduction programs including, but not limited to, workers compensation, property and liability insurance, and safety programs to reduce or eliminate financial and operational losses to the City. Manages Risk Management activities and issues throughout the City. SUPERVISION EXERCISED May exercise technical and functional supervision over administrative support staff. ESSENTIAL DUTIES Prepare, recommend, and administer the Division of Risk Management budget and monitor fiscal matters to assure conformance with budget constraints and risk program initiatives. Prepare and administer a risk management plan by developing standards and assessing and evaluating various risk mitigation techniques and assisting with implementation among City departments. Conduct technical research analysis and prepare detailed reports and recommendations on issues concerning the functions and operations of risk programs. Assess potential risk impacts and make recommendations regarding interpretation and compliance options to City departments. Consult with department heads and City officials to identify and remedy at-risk facilities, work processes, conditions and/or situations, providing technical advice, and coordinating training programs as needed. Coordinate with a commercial broker and insurance carriers to develop, implement, and monitor cost-effective insurance programs to cover City-owned property, general liability, liability of vehicles and employees when warranted. Monitor commercial insurance coverage levels and endorsements as exposures change and new products become available. Work with actuaries to understand and recommend appropriate levels of funding for City liabilities and risk management programs. Develop and implement City-wide risk management policies and risk avoidance programs. Respond to inquiries on program policy and procedural matters as appropriate. Review and evaluate existing and pending safety rules and regulations. Identify, conduct, document, and/or arrange needed safety and liability training, and recommend incentive and recognition programs as part of the safety program. Develop and maintain tracking and retrieval system for monitoring claims and potential claims filed against the City. Use system and data to understand City risks and assist City officials and employees in effectively managing risk. Administer liability claims; conduct investigation of liability claims, including responding to incident scenes, preserving evidence, taking photos and/or video, taking statements, locating witnesses, and obtaining cost and repair estimates; manage claims processing, including validity and liability assessment, recommending legal dispositions, and documenting caseload. Assist the City's insurance carrier and departments in gathering claims information, evaluating claims, minimizing City impacts and recommending corrective action is taken where necessary. Adjust City covered no-fault claims made under City ordinances; administer funds; communicate with claimants and work to facilitate the best outcome possible. Administer Worker's Compensation claims; compile, disseminate, and analyze OSHA Reports, incident investigations, safety programs, risk, accident, and loss reduction programs, and tracking of the risk management fund; encourage mitigation of costs and appropriate use of transitional duty; evaluate employee safety issues; participate in the process for and facilitate inspections of work sites to assure that the City is in compliance with all applicable state and federal safety codes, regulations and laws. Participate in Emergency Management loss control initiatives; collaborate with other City departments in preparation for and responding to disasters. Prepare and make in-person and virtual presentation to groups including employees, elected and appointed officials, and outside organizations Perform other related duties and responsibilities as assigned. MINIMUM QUALIFICATIONS Education: Bachelors degree in risk management, insurance, finance, public administration, law, or a related field. Experience: Five years of progressively responsible experience in risk management, property and liability insurance or safety programs, claims adjusting, local government administration, or combination of such. Municipal risk management experience is preferred. Certifications/Licenses: Valid Utah Driver's License Associate of Risk Management certification preferred Ability to obtain and maintain Utah Criminal Justice Information System (UCJIS) Certification through the Bureau of Criminal Identification (BCI) KNOWLEDGE, SKILLS, AND ABILITIES Knowledge of: Pertinent Federal, State, and local laws, rules, and regulations related to risk management. Tort law, insurance adjusting practices, risk management principles, and safety practices, principles, and theories. Modern office practices, methods, and computer equipment. Safe driving principles and practices. Skill with: Operating office equipment including computer equipment and software. Skills must include a working knowledge of Microsoft Word and Excel. Operating a motor vehicle safely Ability to: Read, interpret, and apply laws, rules, regulations, policies and/or procedures. Evaluate information against a set of standards. Solve a problem by using logic to identify key facts, explore alternatives, and propose quality options. Use effective methods and techniques to deal with and resolve complex issues in a legally defensible manner. Communicate clearly and concisely, both orally and in writing. Establish, maintain, and foster positive and harmonious working relationships with those contacted in the course of work. WORKING CONDITIONS AND PHYSICAL DEMANDS Work in a standard office environment which includes reaching, bending, sitting, standing, talking, hearing, and listening.
