The Role:
As the Assistant General Counsel, Product & Regulatory Legal you will play a key role in providing legal guidance in supporting Upstart's product and marketing initiatives, as well as in developing new products and features to serve the personal loan, open line of credit, small dollar loan and auto refinance market.

Strategic Legal Leadership & Team Management
Lead and develop a team of attorneys and legal professionals within the Product & Regulatory Legal Team, fostering a culture of accountability, collaboration and professional growth
Serve as the primary legal advisor for origination-related matters, guiding the product and marketing teams through complex legal and regulatory considerations
Act as a key escalation point for the legal team, ensuring issues are efficiently triaged and resolved, and provide timely, business-oriented recommendations
Product & Regulatory Counsel
Provide strategic legal counsel on product development, marketing, and customer onboarding for personal loan, small dollar loan, open line of credit, and auto refinance products offered through Upstart's bank partnership platform
Conduct and oversee legal research and analysis on federal and state consumer finance laws, developing practical requirements documentation and compliant marketing and origination frameworks
Monitor industry trends, regulatory changes, and enforcement developments to proactively advise business leaders on risk and opportunity areas
Cross-Functional Partnership
Partner with Product, Growth, Risk, and Compliance to design compliant and customer-friendly financial products and online experiences
Collaborate across legal teams-including lawyers supporting Privacy, Fair Lending, Capital Markets, and Commercial areas-to support enterprise-wide initiatives
Build and maintain trusted relationships with internal stakeholders, influencing product and marketing strategies with sound, business-oriented legal guidance
Legal Risk Identification and Management
Advise on disputes and issues escalated from the Compliance team, particularly those related to marketing or loan origination practices
Identify and communicate key legal risks to business partners; ability to distill complex legal matters and risks for senior leadership in a clear and actionable manner, synthesizing complex concepts into concise recommendations
Minimum Qualifications
J.D. degree with superior academic credentials and a state bar membership;
At least 10+ years of experience in a top-tier law firm, government, in-house legal department, and/or fintech/startup experience with at least 5 years focused on in marketing and consumer loan origination;
In-depth knowledge of federal and state open and closed end consumer lending and consumer protection laws, including FCRA, TILA, ECOA, GLBA, UDAAP, EFTA, ESIGN, FDCPA, bankruptcy, AML/BSA, and servicing/debt collection laws;
Experience with marketing, bank partnership programs, personal loans, small dollar lending, auto refinance loans, and open lines of credits; and
Strong communication skills with a demonstrated ability to effectively and proactively provide quick, concise, and practical legal advice involving competing interests.
Preferred Qualifications
Experience with use of AI in providing solid legal advice and developing team efficiencies
Experience with loan servicing and debt collection, data privacy and security, and auto retail lending/retail installment sales contracts;
Vendor management and vendor contract negotiation experience; and
State licensing and exam experience.
Position location This role is available in the following locations: Remote, San Mateo, CA, and Columbus, OH
Time zone requirements The team operates on the East/West coast time zones.
Travel requirements As a digital first company, the majority of your work can be accomplished remotely. QUALIFICATIONS:
Candidates must present the following qualifications to be considered eligible for this position:
Member of the Bar in good standing in relevant jurisdictions, including New York or New Jersey.

CPCS is the state agency in Massachusetts responsible for providing an attorney when the state or federal constitution or a state statute requires the appointment of an attorney for a person who cannot afford to retain one. The agency provides representation in criminal, delinquency, youthful offender, family regulation, guardianship, mental health, sexually dangerous person, and sex offender registry cases, as well as in appeals and post-conviction and post-judgment proceedings related to those matters.

POSITION OVERVIEW
The Public Defender Division provides legal representation and advocacy to indigent clients who are charged with criminal offenses in both the District and Superior Courts. Public Defenders begin their work by representing clients who are charged with criminal offenses within the final jurisdiction of the District Court, including misdemeanors and felonies, see G.L. c.218, § 26, and some serious sexual offenses, and occasionally handle initial commitment proceedings under G.L. c.123, §§ 12(e), 35. After gaining experience on cases within the final jurisdiction of the District Court, it is expected that Public Defenders will represent clients in the Superior Courts and occasionally represent clients on interlocutory appeals, civil commitments, and certain collateral matters as permitted by a supervisor. It is also expected that Public Defenders, as they gain experience, will act as informal mentors and advisors to other staff attorneys in the office.
New Trial Attorneys in the Public Defender Division begin their CPCS career with a nationally recognized, comprehensive, skills-based training course to ensure they are ready to represent their clients to their full capabilities. Continuing legal education programs for new and experienced Trial Attorneys are held periodically to guarantee our Trial Attorneys are up to date on the law and have the skills necessary to provide zealous representation to their clients.

Qualifications
MINIMUM ENTRANCE REQUIREMENTS
A Trial Attorney must be committed to serving a culturally diverse, low-income population and must be eligible to practice law in Massachusetts, either as a member of the Massachusetts bar, as a law school graduate under Supreme Judicial Court Rule 3:03, or as an attorney licensed in another jurisdiction who is covered by Supreme Judicial Court Rule 3:04. A recent law school graduate who is ineligible to practice under SJC Rule 3:03 will be hired as a paralegal with the understanding that they will be promoted to trial attorney once admitted to practice in Massachusetts;
Access to an automobile in order to travel to courts, clients, and investigation locations that are not easily accessible by public transportation; and,

The Office of the Attorney General (OAG) is seeking a skilled trial attorney to fill a full-time Assistant Attorney General Position in Caribou. The OAG has a telework policy providing the opportunity to work from home. Also, court events are in person, via Zoom or telephonic. There is also a possibility of time in the OAG's Bangor office. The primary responsibility of the Assistant Attorney General will include handling parentage establishment, order establishment and child support enforcement services for the Division of Support Enforcement and Recovery (DSER) within the Office of Family Independence in the Department of Health and Human Services. The AAG will be assigned to Houlton, Caribou, Presque Isle and Fort Kent District Courts in Aroostook County and the Calais and Machias District Courts in Washington County. The AAG is also assigned to the Aroostook and Washington County Probate Courts and the Passamaquoddy Tribal Courts. The Caribou office currently has +- 100 open cases and Washington County has 67 open cases. Other responsibilities include representing DSER in administrative support proceedings, handling 80C reviews of agency action and Law Court appeals.
